A resolution exempting 11 Music Square E #104, from the minimum distance requirements for obtaining a Short Term Rental Property - Not Owner-Occupied permit pursuant to Substitute Ordinance No. BL2019-78.

WHEREAS, Substitute Ordinance No. BL2019-78, as amended, adopted at the July 7, 2020 Council meeting, provides that no new STRP - not owner-occupied, permit shall be issued to an applicant whose location is less than one hundred feet from a religious institution, a school or its playground, a park, or a licensed day care center or its playground unless the Metropolitan Council approves an exemption from the minimum distance requirements upon the adoption of a resolution, after a public hearing, receiving 21 affirmative votes; and

WHEREAS, Mr. Nick Morris has filed an application with the Metropolitan Department of Codes Administration for a STRP, non-owner occupied, permit for property located at 11 Music Square E #104, pursuant to Substitute Ordinance No. BL2019-78; and

WHEREAS, in accordance with Substitute Ordinance No. BL2019-78, a public hearing was held at the August 16, 2022, meeting of the Metropolitan Council regarding the exemption of 11 Music Square E #104, from the minimum distance requirements to obtain a STRP - not owner-occupied permit.

NOW, THEREFORE BE IT RESOLVED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Pursuant to Substitute Ordinance No. BL2019-78, the Metropolitan Council hereby approves the exemption of 11 Music Square E #104, from the minimum distance requirements for obtaining a STRP - not owner-occupied permit.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to the Director of the Department of Codes Administration.

Section 3. This Resolution shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
