This resolution approves two intergovernmental agreements between the Nashville Department of Transportation (“NDOT”) and the Tennessee Department of Transportation (“TDOT”) for roadway and infrastructure improvements. The first agreement concerns improvements to Cowan Street and Marine Drive. The second agreement concerns improvements to James Robertson Parkway.
Tennessee Code Annotated § 12-9-104(a)(2)(b) authorizes the Metropolitan Government to enter into intergovernmental agreements with the State of Tennessee by resolution.
Cowan Street and Marine Drive
According to an attached memorandum of understanding between TDOT, the Metropolitan Government, and the East Bank Development Authority (“EBDA”), the scope of work is as follows:

• Extension of Marine Drive from Dickerson Pike to Cowan Street under Interstate 24
• Widening Cowan Street from Spring Street to Marine Drive
• Improvements for Dickerson Pike from Meridian Street to Grace Street
• Installing a new 72-inch regional stormwater trunk line.
TDOT is responsible for all phases of the project, except for the final striping on Marine Drive and Cowan Street, the acquisition of right-of-way for a proposed shared access roadway, the installation of all transit equipment, and the removal and reinstallation of the existing buffalo statues in the middle of Dickerson Pike. The parties will work to complete the Cowan Street phase by June 30, 2029, the Interstate 24 bridges phase by September 30, 2029, and the Marine Drive phase by September 30, 2030.
The estimated total cost of the project is $208,000,000. NDOT will be responsible for 50 percent of the project cost, or $104,000,000, over the course of four payments. The term of the agreement begins upon approval of all required parties. The agreement may be terminated by TDOT with 30 days’ notice, following a required conference with NDOT or by either party for cause.
This agreement separately amends an agreement between TDOT and NDOT, as approved by Resolution No. RS2021-909. This amendment replaces the text of the agreement for a Cleveland Street Extension and Bike/Pedestrian Connectivity from East Nashville to River North Development with the agreement for Marine Drive, from Dickerson Pike to Cowan Street under Interstate 24.
James Robertson Parkway

• Constructing tie-ins to South 2nd Street from Jackson Robertson Parkway to Woodland Street
• Installing a new 72-inch regional stormwater trunk line.
