Agenda Analysis

Analysis

On October 29, 2025, a Davidson County Sheriff’s Office (“DCSO”) bus carrying David Claiborne was driving down Ezell Pike approaching a curve in the road. A driver approaching the curve from the opposite direction stopped their vehicle to allow the DCSO bus to better navigate the curve. The DCSO bus driver collided with the front side of the approaching driver’s vehicle.

Mr. Claiborne went to the hospital the next day for neck and back pains. Mr. Claiborne received x-rays and CT scans and was diagnosed with a muscle strain. On December 4, 2025, Mr. Claiborne received additional x-rays and an MRI scan, which showed Mr. Claiborne had multiple bulging discs.

The parties have participated in settlement negotiations and have agreed upon the settlement amount of $28,000. The Department of Law recommends settlement of Mr. Claiborne’s personal injury claim for this amount.

The DCSO employee driving the bus received a written reprimand for their involvement in the collision.

Fiscal Note: The total settlement amount is $28,000. This settlement would be the 9th payment, after approval by Metropolitan Council, from the Self-Insured Liability Fund in FY26 for a cumulative total of $768,758. The fund balance would be $10,711,219 after this payment.
