Agenda Analysis
Analysis
On March 11, 2025, an undercover Metropolitan Nashville Police Department (“MNPD”) detective was following a suspect’s vehicle while driving westbound on Heiman Street. The detective approached the intersection with Dr. D.B. Todd Jr Boulevard, where a stop sign and a cluster of poles obscure the sightline. The MNPD detective did not come to a complete stop, entered the intersection, and collided with a vehicle in which Jaquisha Marable was a passenger.
Ms. Marable’s knee struck the front dashboard during the crash. She was taken to the emergency room by ambulance after reporting knee pain and was discharged with crutches. Ms. Marable went to an orthopedic specialist, who found an extensive meniscal tear in her right knee consistent with sudden trauma. She later underwent surgery to repair the knee and eventually regained function. Ms. Marable incurred more than $72,000 in medical expenses and was compromised in her ability to function as caretaker for her three-year-old grandson. Ms. Marable filed a personal injury claim against the Metropolitan Government.
The parties have participated in settlement negotiations and have agreed upon the settlement amount of $125,000. The Department of Law recommends settlement of Ms. Marable’s personal injury claim for $125,000.
The detective involved in the incident received a one-day suspension without pay and additional driver’s training as a result of the wreck.
Fiscal Note: The total settlement amount is $125,000. This settlement would be the sixth (6th) payment, after approval by Metropolitan Council, from the Self-Insured Liability Fund in FY27 for a cumulative total of $632,258. The fund balance would be $11,129,872 after this payment.
