WHEREAS, the abandonment of approximately 50 linear feet of existing six-inch water main, approximately 363 linear feet of existing 12-inch water main, approximately 170 linear feet of existing 12-inch sanitary sewer main, approximately 397 linear feet of existing 15-inch sanitary sewer main, one fire hydrant assembly and two sanitary sewer manholes, and the acceptance of approximately 57 linear feet of new eight-inch water main (DIP), approximately 365 linear feet of new 12-inch water main (DIP), approximately 63 linear feet of new 12-inch sanitary sewer main (PVC), approximately 260 linear feet of new 15-inch sanitary sewer main (PVC), approximately 167 linear feet of new 15-inch sanitary sewer main (DIP), one new fire hydrant assembly and five new sanitary sewer manholes, for property located at 110 Berry Street, also known as Berry Street Infrastructure, are needed to construct project numbers 25-WL-71 and 25-SL-167; and,

WHEREAS, BL2024-345 authorizes the Metropolitan Department of Water and Sewerage Services to approve extensions, additions, improvement, or works by resolution of the Metropolitan Council; and,

WHEREAS, the Metropolitan Planning Commission approved with conditions mandatory referral No. 2025M-197ES-001 on January 28, 2026, for the abandonment and acceptance of said water and sanitary sewer mains, fire hydrant assemblies, and sanitary sewer manholes; and,

WHEREAS, NES’s condition that all work must maintain clearances with any utility poles to prevent undermining the integrity of the base of the poles, will be met as this is standard practice.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 50 linear feet of existing six-inch water main, approximately 363 linear feet of existing 12-inch water main, approximately 170 linear feet of existing 12-inch sanitary sewer main, approximately 397 linear feet of existing 15-inch sanitary sewer main, one fire hydrant assembly and two sanitary sewer manholes, and to accept approximately 57 linear feet of new eight-inch water main (DIP), approximately 365 linear feet of new 12-inch water main (DIP), approximately 63 linear feet of new 12-inch sanitary sewer main (PVC), approximately 260 linear feet of new 15-inch sanitary sewer main (PVC), approximately 167 linear feet of new 15-inch sanitary sewer main (DIP), one new fire hydrant assembly and five new sanitary sewer manholes, for property located at 110 Berry Street, also known as Berry Street Infrastructure, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.

Section 3.                     This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

T.C.A. § 7-35-406(a)(2) and Ordinance No. BL2024-345 allow the Metropolitan Department of Water and Sewerage Services to approve extension, additions, or works by resolution of the Metropolitan Council.

 

This proposal has been approved by the Planning Commission.
