A resolution to amend Ordinance BL2024-171 to authorize The Metropolitan Government of Nashville and Davidson County to abandon sanitary sewer mains and sanitary sewer manholes, for three properties located at 2111, 2115 and 2151 West Summitt Avenue, also known as Summitt View, Revision 1 development (MWS Project Nos. 22-WL-26 and 22-SL-64 and Proposal No. 2023M-181ES-002).

WHEREAS, Ordinance No. BL2024-171, approved March 8, 2024, authorized the acceptance of approximately 1,874 linear feet of new eight-inch water main (DIP), approximately 1,675 linear feet of new eight-inch sanitary sewer main (DIP), approximately 1,345 linear feet of new eight-inch sanitary sewer main (PVC), three fire hydrant assemblies, 28 sanitary sewer manholes and easements, for three properties located at 2111, 2115 and 2151 West Summitt Avenue, also known as Summitt View; and,
WHEREAS, the abandonment of approximately 395 linear feet of existing eight-inch concrete sanitary sewer main and two sanitary sewer manholes, for three properties located at 2111, 2115 and 2151 West Summitt Avenue, now known as Summitt View, Revision 1 development, is needed to construct Project No. 22-SL-64; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-181ES-002 on September 10, 2024, for revisions to the original mandatory referral; and,
WHEREAS, Ordinance No. BL2024-171 provides that amendments to the legislation shall be approved by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Ordinance No. BL2024-171 is hereby amended deleting section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 395 linear feet of existing eight-inch concrete sanitary sewer mains and two sanitary sewer manholes, and to accept approximately 1,874 linear feet of new eight-inch water main (DIP), approximately 1,675 linear feet of new eight-inch sanitary sewer main (DIP), approximately 1,345 linear feet of new eight-inch sanitary sewer main (PVC), three fire hydrant assemblies, 28 sanitary sewer manholes and easements, for three properties located at 2111, 2115 and 2151 West Summitt Avenue, also known as Summitt View, Revision 1 development, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.
Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

The proposed resolution would amend BL2024-171 to abandon approximately 395 linear feet of existing eight-inch concrete sanitary sewer main and two sanitary sewer manholes at the same property.
These changes have been approved by the Planning Commission.
