An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to accept new public water and sanitary sewer mains, fire hydrant assemblies, sanitary sewer manholes and easements, for three properties located at 4421 and 4395 Maxwell Road, and Maxwell Road (unnumbered), also known as Percy Cove (Onsite), (MWS Project Nos. 22-WL-113 and 22-SL-238 and Proposal No. 2023M-128ES-001).

WHEREAS, the acceptance of approximately 2,966 linear feet of new eight-inch water main (DIP), approximately 585 linear feet of new six-inch water main (DIP), approximately 2,983 linear feet of new eight-inch sanitary sewer main (PVC), approximately 76 linear feet of new eight-inch sanitary sewer main (DIP), seven new fire hydrant assemblies, twenty new sanitary sewer manholes and easements, for property located at 4421 and 4395 Maxwell Road, and Maxwell Road (unnumbered), also known as Percy Cove (Onsite), is needed to construct project numbers 22-WL-113 and 22-SL-238; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-128ES-001 on August 9, 2023, for the acceptance of said water and sanitary sewer mains, fire hydrant assemblies, sanitary sewer manholes and easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to accept approximately 2,966 linear feet of new eight-inch water main (DIP), approximately 585 linear feet of new six-inch water main (DIP), approximately 2,983 linear feet of new eight-inch sanitary sewer main (PVC), approximately 76 linear feet of new eight-inch sanitary sewer main (DIP), seven new fire hydrant assemblies, twenty new sanitary sewer manholes and easements, for property located at 4421 and 4395 Maxwell Road, and Maxwell Road (unnumbered), also known as Percy Cove (Onsite), as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the acceptance authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Fiscal Note: This ordinance has no cost to Metro. Donated easements have no market value according to the Department of Water Services.
