WHEREAS, on November 3, 2024, the basement of Nudie’s Honky Tonk flooded with sewage from an obstruction in the Metro sewer main. Upon investigation, it was discovered that debris from previous and ongoing construction in the area was thought to be the culprit causing the backup; and
WHEREAS, after investigation, the Department of Law believes the settlement listed in Section one is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the property damage claim of Broadway Honky Tonk Venture, LLC be compromised and settled for a total of $35,304.00, and that this amount be paid from the Self-Insured Liability Fund.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle the property damage claim of Broadway Honky Tonk Venture, LLC for the sum of $35,304.00, with said amount to be paid from the Self-Insured Liability Fund.
Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

On November 3, 2024, the basement of Nudie’s Honky Tonk flooded with sewage from debris that obstructed the main Metro Water Services sewage line. Debris found in the sewer main appears to have come from previous and ongoing construction, according to Metro Water Services.
When the sewage backup was noticed, Nudie’s Hony Tonk closed its doors and contacted an emergency cleaning crew and Metro Water Services. Sewage was in the kitchen, two walk-in coolers, the ice machine room, closets, elevator shaft, staircase, and office. Costs for clean-up, repairs, and lost revenue amounted to $35,304.
The parties have participated in settlement negotiations and have agreed upon the settlement amount of $35,304, subject to approval from the Metropolitan Council. The Department of Law recommends settlement of the property damage claim of Broadway Honky Tonk Venture, LLC, dba Nudie’s Honky Tonk, for $35,304.
Fiscal Note: The total settlement amount is $35,304. This settlement along with Resolution No. RS2025-1368, RS2025-1369 and RS2025-1372 would be the 1st, 2nd, 3rd and 4th payments, after approval by Metropolitan Council, from the Self-Insured Liability Fund in FY26 for a cumulative total of $445,194. The fund balance would be $10,946,658 after these payments.
