Agenda Analysis

Analysis

On January 31, 2025, Erica Taylor, formerly Erica Clark, was driving down 23rd Avenue North behind a flatbed truck driven by an NDOT employee. The NDOT employee missed a turn and reversed to make the turn. The NDOT driver struck the front of Mrs. Taylor’s vehicle with the rear of the truck.

After the incident, Mrs. Taylor went to the ER complaining of headaches, knee pain, and low back pain radiating into the legs. Mrs. Taylor received physical therapy and advanced imaging. Mrs. Taylor received chiropractic care for the injury.  Mrs. Taylor filed a lawsuit against the Metropolitan Government alleging negligence.

The parties have participated in settlement negotiation and have agreed upon the settlement amount of $63,500. The Department of Law recommends settlement of Mrs. Taylor’s personal injury claim for $63,500.

The NDOT employee driving the truck received a reprimand for their involvement in the collision.

Fiscal Note: The total settlement amount is $63,500. This settlement would be the 9th payment, after approval by Metropolitan Council, from the Self-Insured Liability Fund in FY26 for a cumulative total of $740,758. The fund balance would be $10,612,974 after this payment.
