A resolution to extend the deadline for the Contract and Compliance Board to provide recommendations for the scope of safety plans for construction project procurement and contractor payment application requirements to the Purchasing Agent and the Metropolitan Council.

WHEREAS, Section 4.20.130 of the Metropolitan Code of Laws established the Contract and Compliance Board to oversee construction contracts of the Metropolitan Government; and,
WHEREAS, pursuant to Section 4.20.130 of the Metropolitan Code of Laws, the Contract and Compliance Board has the duty to provide recommendations for the scope of safety plans for construction project procurement, such as (a) types and size of projects, (b) whether safety plans should be required as part of the procurement process, and (c) other relevant issues related to safety plans; and,
WHEREAS, pursuant to Section 4.20.130 of the Metropolitan Code of Laws, the Contract and Compliance Board has the duty to provide recommendations related to contractor payment application requirements, including whether such requirements should be required in the metropolitan code of laws; and,
WHEREAS, these recommendations are required to be submitted to the Purchasing Agent and the Metropolitan Council no later than July 1, 2025, unless extended by a resolution of the Metropolitan Council; and,
WHEREAS, the official start date for the Contract and Compliance Board Executive Director was May 12, 2025; and,
WHEREAS, the Contract and Compliance Board requires additional time to submit its recommendations and has requested an extension of the July 1, 2025 deadline to September 1, 2025; and,
WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that the deadline for the Contract and Compliance Board to submit its recommendations be extended to September 1, 2025.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the deadline of July 1, 2025, for the Contract and Compliance Board to provide recommendations for the scope of safety plans for construction project procurement and contractor payment application requirements to the Purchasing Agent and the Metropolitan Council is hereby extended to September 1, 2025.
Section 2. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution extends the deadline for the Contract and Compliance Board to provide recommendations for the scope of safety plans for construction project procurement and contractor payment application requirements to the Purchasing Agent and the Metropolitan Council.
Section 4.20.130 of the Metropolitan Code of Laws provides that these recommendations be provided by July 1, 2025, as approved by the Metropolitan Council through Ordinance No. BL2025-375. The code allows this deadline to be extended by a Council resolution.
The proposed resolution extends the date to provide these recommendations from July 1, 2025, to September 1, 2025.
