WHEREAS, Tennessee Code Annotated § 12-3-1205(b) allows the Metropolitan Government of Nashville and Davidson County (“Metro”) to participate in a cooperative purchasing agreement for the procurement of any goods, supplies, services, or equipment with an agency of the United States; and,
WHEREAS, Tennessee Code Annotated § 12-3-1205(b) allows Metro to participate in a master agreement with an agency of the United States by adopting a resolution accepting the terms of the master agreement; and,
WHEREAS, the Purchasing Agent desires to participate in the master agreement between MBF Industries, Inc. and the United States General Services Administration, a copy of which is attached hereto and incorporated herein; and,
WHEREAS, this master agreement was requested by the Metropolitan Nashville Police Department but is available to all Metro Departments to utilize; and,
WHEREAS, Metro’s participation in this out-of-state master agreement is limited to a term that will not exceed sixty months; and,
WHEREAS, approval of the master agreement is in the best interest of the citizens of Metropolitan Government of Nashville and Davidson County.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the master agreement between MBF Industries, Inc. and the United States General Services Administration, a copy of which is attached hereto and incorporated herein, is hereby approved.
Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution accepts the terms of a cooperative purchasing agreement with MBF Industries, Inc. for law enforcement vehicles that are manufactured for a special purpose and attachments for the Metropolitan Nashville Police Department (“MNPD”).
The original agreement is between the U.S. General Services Administration, and MBF Industries, Inc. The anticipated project value is $2,000,000. The agreement would expire on May 11, 2031.
According to the Cooperative Request form, the original agreement was with the U.S. Government so it is unlikely that Metro would be able to obtain better pricing through its own solicitation. This agreement authorizes MNPD and Nashville Fire Department to purchase law enforcement and fire fighting vehicles and attachments including mobile water supply attachments, fire fighting vehicle glider kits, SWAT vehicles, and mobile crime scene vehicles.
T.C.A. § 12-3-1201(c) and Metropolitan Code of Laws § 4.12.090(b) authorizes local governments to purchase goods or services included in federal General Services Administration contracts including vehicles manufactured for a special purpose.
Fiscal Note: According to the Cooperative Request Review from Division of Purchases, the anticipated project value is $2,000,000. The anticipated savings to Metropolitan Government through utilizing this cooperative purchasing agreement is $165,071.
