An ordinance authorizing the granting of temporary construction easements to Piedmont Natural Gas Company, INC. (“Piedmont”) on a parcel or property owned by the Metropolitan Government (Proposal No. 2021M-013ES-001).

WHEREAS, the Metropolitan Government of Nashville and Davidson County owns certain real property (Metro Parcel ID 14603000300; the “Property”); and,
WHEREAS, Piedmont has requested a temporary construction easements (the “Easement”) on the area designated TCE as shown on Exhibit A for the purposes of performing construction activities and laying, storing, erecting, parking, and/or protecting any equipment, vehicle’s materials, fill, components, parts, and tools associated with the construction of Piedmont’s natural gas pipeline and appurtenant facilities for which this temporary construction easement is given; and,
WHEREAS, Piedmont has agreed to pay fair market value as compensation for the Easements; and,
WHEREAS, trees are a utility that improves air quality, manages stormwater, and supports public health for Nashville’s residents, and protection of trees on public property is especially important; and
WHEREAS, as required by Section 17.24.110 of the Metropolitan Code of Laws, existing trees shall be protected at all times during development activities within the TCE Area identified on Exhibit A; and
WHEREAS, the Board of Education has approved the granting of the Easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The granting of the following temporary construction easement to Piedmont for the construction of Piedmont’s natural gas pipeline and appurtenant facilities on the area designated TCE as shown on Exhibit A is hereby approved.

Section 2. The Director of Public Property Administration is authorized to execute and record the Easements and other such documents as may be necessary to carry out the objective of this ordinance.
Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance, as amended, grants temporary construction easements to Piedmont Natural Gas Company, Inc., across a parcel owned by the Metropolitan Government. This easement will be used for the purposes of performing construction activities and laying, storing, erecting, parking, and/or protecting any equipment, vehicle’s materials, fill, components, parts, and tools associated with the construction of Piedmont’s natural gas pipeline. The property is part of the John Overton High School campus. This easement has been approved by the Board of Education.
The Director of Public Property is authorized to execute and record the easements and any other documents necessary to carry out the objective of this ordinance.
Fiscal Note: Piedmont has agreed to pay $17,363, which has been determined to be fair market value, as compensation for the easements.
