WHEREAS, the Metropolitan Department of Water and Sewerage Services and other departments of the Metropolitan Government may need to seek assistance or offer assistance during times of emergency to other governmental entities; and,

WHEREAS, the Tennessee Water/Wastewater Agency Response Network ("TnWARN") has proposed that The Metropolitan Government of Nashville and Davidson County enter into a mutual aid and assistance agreement for public and private water and wastewater utilities to participate in an intrastate mutual aid and assistance program, a copy of which agreement is attached hereto and incorporated herein; and,

WHEREAS, T.C.A. §58-8-103 provides that governmental entities may by resolution make agreements relative to mutual aid and emergency and disaster assistance; and,

WHEREAS, it is to benefit the citizens of The Metropolitan Government of Nashville and Davidson County that this mutual aid and assistance agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That the mutual aid and assistance agreement by and between The Metropolitan Government of Nashville and Davidson County and participating public and private utilities, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewerage Services is hereby authorized to execute the same.

Section 3.                     This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves a mutual aid and assistance agreement between the Metropolitan Government and participating public and private utilities to coordinate response activities and resources during emergencies.

 

Tennessee Code Annotated section 58-8-103 authorizes local governments to approve mutual aid and emergency assistance agreements by resolution.

 

This resolution provides for the Metropolitan Department of Wastewater Services (“MWS”) to join the Tennessee Water/Wastewater Agency Response Network (“TnWARN”). Through TnWARN, network members coordinate response activities and share resources during emergencies through personnel, equipment, and supplies from outside the area of impact. To the extent practicable, TnWARN members shall also participate in Mutual Aid and Assistance activities conducted under the State of Tennessee Intrastate Mutual Aid and Assistance Program and the Interstate Emergency Management Assistance Compact (EMAC).

 

Unless otherwise mutually agreed upon, a TnWARN member requesting assistance shall reimburse the TnWARN responding member costs incurred while providing aid and assistance.

 

 Fiscal Note: Metro will receive reimbursements from emergencies requiring assistance in the form of personnel, equipment, and supplies through the Mutual Aid and Assistance Program under this agreement.
