WHEREAS, to discourage illegal dumping and littering, the Metropolitan Beautification & Environment Commission of the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”) has proposed to beautify an underpass located near 3246 Moorewood Drive, under the Briley Parkway/State Route 155 bridge, within the Parkwood Neighborhood, by installing murals on the walls, adding attractive gravel to the ground surfaces, and installing lighting underneath the existing underpass (“the Mural Project”); and,

WHEREAS, per the State of Tennessee, Department of Transportation (“TDOT”) rules, a resolution of support is required to apply for a state license for art painted on TDOT’s required engineering features; and,

WHEREAS, the conceptual plan attached hereto as “Exhibit A,” shows the Beautification & Environment Commission’s recommended concept for the Mural Project; and,

WHEREAS, NDOT’s application for a license agreement with TDOT for the conveyance of interest of surplus TDOT right-of-way is attached hereto as “Exhibit B”; and

WHEREAS, it is in the best interest of the Metropolitan Government of Nashville and Davidson County that the Mural Project is supported and that NDOT’s license agreement application is approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That the conceptual plan for the beautification of an underpass located near 3246 Moorewood Drive, in the Parkwood Neighborhood, under the Briley Parkway/State Route 155 bridge, attached hereto as “Exhibit A” and incorporated herein, is hereby supported by the Metropolitan Council.

Section 2.                      That the application for a license between the Metropolitan Government, acting by and through NDOT, and the State of Tennessee, acting by and through TDOT, attached hereto as “Exhibit B” and incorporated herein, is hereby approved, and the Metropolitan Government is authorized to enter into a license agreement with the State of Tennessee for this purpose.

Section 3.                      That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This resolution supports the beautification of an underpass on Moorewood Drive in the Parkwood Neighborhood, under Briley Parkway/State Route 155 bridge. The resolution also approves an application for a license agreement between the Tennessee Department of Transportation (“TDOT”) and the Metropolitan Government.

 

The Parkwood Community Association and the residents of the Parkwood Neighborhood are desiring to paint a mural on the walls of the underpass located near 3246 Moorewood Drive. TDOT rules require a resolution of support to accompany an application for a state license agreement for Transportation Art painted in TDOT’s highway features. Proposals for Transportation Art must be requested and submitted by the local government and cannot be submitted by non-governmental entities. The local government must also enter into a license agreement with TDOT. A maintenance plan from the Nashville Department of Transportation for the mural project is attached to the resolution.
