A resolution to amend Ordinance No. BL2023-51 to authorize The Metropolitan Government of Nashville and Davidson County to replace the relocation of a fire hydrant assembly with the acceptance of a fire hydrant assembly, for property located at 501 Sylvan Street, also known as 5th and Summer Revision 1 (MWS Project No. 23-WL-59 and Proposal No. 2023M-138ES-002).

WHEREAS, Ordinance No. BL2023-51, approved November 9, 2023, authorized the acceptance of approximately 125 linear feet of new eight-inch sanitary sewer main (DIP), one sanitary sewer manhole, and the relocation of one fire hydrant assembly, for property located at 501 Sylvan Street, also known as Fifth and Summer; and,
WHEREAS, the acceptance of a fire hydrant assembly replacing the relocation of an existing fire hydrant assembly, for property located at 501 Sylvan Street, also known as Fifth and Summer Revision 1, is now needed to construct Project No. 23-WL-59; and,
WHEREAS, there were no revisions to Project No. 23-SL-136; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-138ES-002 on November 10, 2025, for revisions to the previous mandatory referral; and,
WHEREAS, Ordinance No. BL2023-51 provides that amendments to the legislation shall be approved by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Ordinance No. BL2023-51 is hereby amended by deleting Section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to accept approximately 125 linear feet of new eight-inch sanitary sewer main (DIP), one sanitary sewer manhole and one fire hydrant assembly, for property located at 501 Sylvan Street, also known as 5th and Summer Revision 1, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the acceptance authorized by this resolution.
Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

The ordinance accepted approximately 125 linear feet of new eight-inch sanitary sewer main (DIP), one sanitary sewer manhole, and the relocation of one fire hydrant assembly, for property located at 501 Sylvan Street, also known as Fifth and Summer.
The proposed resolution would amend BL2023-31 to accept a fire hydrant assembly instead of the proposed replacement for property located at Fifth and Summer.
