An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing public sanitary sewer main, fire hydrant assembly and sanitary sewer manholes, and to accept new sanitary sewer main, fire hydrant assembly, sanitary sewer manholes and easements, for two properties located at 1205 and 1223 Third Avenue North, also known as 3rd and Madison Townhomes Phase 1 (MWS Project Nos. 25-WL-47 and 25-SL-111 and Proposal No. 2026M-030ES-001).

WHEREAS, the abandonment of approximately 537 linear feet of existing eight-inch sanitary sewer main, one fire hydrant assembly and two sanitary sewer manholes, and the acceptance of approximately 827 linear feet of new eight-inch sanitary sewer main (PVC), one fire hydrant assembly, four sanitary sewer manholes and easements, for two properties located at 1205 and 1223 Third Avenue North, also known as 3rd and Madison Townhomes Phase 1, are needed to construct project numbers 25-WL-47 and 25-SL-111; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2026M-030ES-001 on March 31, 2026, for the abandonment and acceptance of said sanitary sewer mains, fire hydrant assemblies, sanitary sewer manholes and easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 537 linear feet of existing eight-inch sanitary sewer main, one fire hydrant assembly and two sanitary sewer manholes, and to accept approximately 827 linear feet of new eight-inch sanitary sewer main (PVC), one fire hydrant assembly, four sanitary sewer manholes and easements, for two properties located at 1205 and 1223 Third Avenue North, also known as 3rd and Madison Townhomes Phase 1, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
