An ordinance approving the acceptance of a permanent easement by the Metropolitan Government, acting by and through the Department of Information Technology Services, from SREIT Hickory Point Nashville, LLC, for the purpose of building and maintaining a radio communications tower and related equipment at 15180 Old Hickory Boulevard. (Proposal No. 2026M-029AG-001.)

WHEREAS, the Metropolitan Government has a permanent easement to use a portion of a tract of land at 15190 Old Hickory Boulevard, Parcel No. 161 00 0 079.00, owned by SREIT Hickory Point Nashville, LLC (“SREIT”), for the purpose of a water tank and line and related ingress and egress; and
WHEREAS, the Metropolitan Government no longer requires this site for a water tank and line and the Department of Information Technology Services (“ITS”), now wishes to use this same site for the purpose of constructing, operating, and maintaining a radio communications tower and related equipment, as well as ingress and egress to the site, in addition to other governmental uses; and
WHEREAS, as described in the easement agreement attached here as Exhibit 1, SREIT proposes to grant, and the Metropolitan Government proposes to accept, a permanent easement allowing the Metropolitan Government these new uses on the site; and
WHEREAS, as consideration for the granting of the easement, the Metropolitan Government will pay STREIT seventy thousand dollars ($70,000.00); and
WHEREAS, it is in the best interest of The Metropolitan Government of Nashville and Davidson County that this easement agreement be approved.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the agreement with SREIT Hickory Point, LLC, attached here as Exhibit 1 and incorporated herein, is hereby approved, and the Director of Public Property is authorized to execute the same.
Section 2. That this ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
