An ordinance to amend Section 10.60.020 of the Metropolitan Code, to transfer the administration related to the registration of burglar and fire alarm systems from the Department of Codes Administration to the Nashville Fire Department.

WHEREAS, currently Section 10.60.020 of the Metropolitan Code sets requirements related to burglar and fire alarm systems, including registration and the payment of fees, directed toward the Department of Codes Administration ("Codes"); and
WHEREAS, the Nashville Fire Department ("NFD") is more appropriately equipped to support and administer the provisions of this program; and
WHEREAS, the Department of Codes and Administration and the Nashville Fire Department agree and desire to amend Section 10.60.020 of the Metropolitan Code to effectuate a transfer of these duties from Codes to NFD; and
WHEREAS, the amendments of these sections of the Metropolitan Code are in the best interest of the citizens of Nashville and Davidson County.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Section 10.60.020 of the Metropolitan Code is hereby amended by deleting Section A and substituting in lieu thereof:
A. Every person who shall own, operate or lease any alarm system, as defined in this chapter, within the Metropolitan Nashville and Davidson County, Tennessee area, whether existing or to be installed in the future, shall, prior to use of the alarm system, register for a permit with the Nashville Fire Department. The registration form shall require, but not be limited to, the following information:
1. The name of the alarm company;
2. Whether installed in a residential or commercial premises;
3. The name, address, email address, business and/or home telephone number of the owner or lessee of the alarm system;
4. The names, addresses and telephone numbers of at least two persons to be notified in the event of an alarm activation, including the name, address, and telephone number of at least one local person to be responsible for the alarm system.
Section 2. That Section 10.60.020 of the Metropolitan Code is hereby amended by deleting Section B and substituting in lieu thereof:
B. Upon initial registration of an alarm system, the owner, operator or lessee of the alarm system shall submit a fee of twenty dollars to the Nashville Fire Department for obtaining a permit for each alarm device in the system if the system is maintained on residential premises, and fifty dollars for each alarm device if the system is maintained on commercial premises. Annual renewal fees of twenty dollars for residential users and fifty dollars for commercial users will apply. All renewal permit registration forms and fees are due annually on or before the end of the month in which the permit is issued. A late fee of five dollars shall be added to any renewal permit registration submitted after the due date.
Section 3. This Ordinance shall take effect immediately after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
