WHEREAS, RS2015-1535 approved an intergovernmental agreement between the State of Tennessee, Department of Transportation (“TDOT”), and the Metropolitan Government, by and through the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”), for Lebanon Pike sidewalk improvements, PIN 121729.00 (the “Agreement”).

WHEREAS, RS2020-512 approved amendment 1 to the Agreement, which replaced in its entirety the language of the Agreement, with the language of amendment 1; and,

WHEREAS, RS2022-1433 approved amendment 2 to the Agreement, which extended the completion date of the project to May 31, 2024; and,

WHEREAS, as set forth in Amendment 3, attached hereto, the parties now desire to amend the Agreement for a third time to replace Exhibit A to the Agreement in its entirety with a new Exhibit A that reflects the change in project costs and to extend the project completion date from May 31, 2024 to June 30, 2026; and,

WHEREAS, it is in the interest of the Metropolitan Government of Nashville and Davidson County that the third amendment be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That Amendment 3 to the intergovernmental agreement between the State of Tennessee, Department of Transportation, and the Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Department of Transportation and Multimodal Infrastructure, for Lebanon Pike sidewalk improvements, attached hereto and incorporated herein by reference, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2.                       Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3.                     That this resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves the third amendment to an intergovernmental agreement between the Tennessee Department of Transportation and the Nashville Department of Transportation and Multimodal Infrastructure. The original agreement, adopted by Resolution No. RS2015-1535, provides for the acceptance of work in connection with the construction of a sidewalk on Lebanon Pike (State Route 24) from McGavock Pike to Old Lebanon Pike.

 

Amendment one to this agreement was approved by Resolution No. RS2020-512 and extended the completion date of the agreement to May 31, 2022. The amendment also added language to allow for the use of TDOT on-call consultants for future services. Amendment two was approved by Resolution No. RS2022-1433 and extended the completion date from May 31, 2022, to May 31, 2024. The total cost of the project, as amended by RS2020-512, was $3,800,000.

 

The amendment under consideration would amend the project costs and extend the project completion date from May 31, 2024 to June 30, 2026. Exhibit A would be replaced to reflect the increased cost of right-of-way phase, which now has a total value of $1,637,400, and the increased costs of construction associated with the project.

 

Fiscal Note: The total estimated cost of the project after this amendment would be $6,681,080, of which Metro would pay 20%. This is an increase of $2,881,080.
