An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing combination sewer main, sanitary sewer main and easements, and to accept new combination sewer main, sanitary sewer main, combination sewer manholes/inlets, sanitary sewer manholes and easements, for three properties located on Edgehill Avenue, also known as Edgehill Townhomes (MWS Project No. 20-SL-196 and Proposal No. 2021M-036ES-001).

WHEREAS, the abandonment of approximately 122 linear feet of existing 60 inch combination sewer main, approximately 223 linear feet of existing 15 inch sanitary sewer main and easements, and the acceptance of approximately 175 linear feet of new 66 inch combination sewer main (RCP), approximately 207 linear feet of new 10 inch sanitary sewer main (PVC), three combination sewer manholes/inlets, four sanitary sewer manholes and easements, for three properties located on Edgehill Avenue, also known as Edgehill Townhomes, are needed to construct project number 20-SL-196; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2021M-036ES-001 on April 26, 2021, for the abandonment and acceptance of said combination and sanitary sewer mains, combination sewer manholes/inlets, sanitary sewer manholes and easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 122 linear feet of existing 60 inch combination sewer main, approximately 223 linear feet of existing 15 inch sanitary sewer main and easements, and to accept approximately 175 linear feet of new 66 inch combination sewer main (RCP), approximately 207 linear feet of new 10 inch sanitary sewer main (PVC), three combination sewer manholes/inlets, four sanitary sewer manholes and easements, for three properties located on Edgehill Avenue, also known as Edgehill Townhomes, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance abandons combination and sanitary sewer mains, and accepts replacement combination and sewer mains, manholes, and easements for three properties located on Edgehill Avenue as part of the Edgehill Townhomes development. Future amendments to this ordinance may be approved by resolution.

Fiscal Note: There is no cost to Metro. Abandoned and donated easements have no market value according to the Department of Water Services.
