A resolution to amend Ordinance No. BL2023-2028 to authorize The Metropolitan Government of Nashville and Davidson County to modify the acceptance of water and sanitary sewer main, fire hydrant assemblies, sanitary sewer manholes and easements, to update Map and Parcel information and add additional phasing, for property now located at 2362 E Zermatt Avenue, also now known as Rose Monte Phase 4-1 (MWS Project Nos. 22-WL-56 and 22-SL-122 and Proposal No. 2023M-085ES-002).

WHEREAS, Ordinance No. BL2023-2028, approved, August 4, 2023, authorized the acceptance approximately 1,702 linear feet of new eight-inch water main (DIP), four new fire hydrant assemblies, approximately 2,597 linear feet of new eight-inch sewer main (PVC), 187 linear feet of new eight-inch sewer main (DIP), 20 new sanitary sewer manholes and easements, for property located at Zermatt Avenue (unnumbered), also known as Rose Monte Phase 4; and,
WHEREAS, the acceptance of approximately 927 fewer linear feet of new eight-inch water main (DIP), approximately 1,628 fewer linear feet of new eight-inch sanitary sewer main (PVC), approximately 103 additional linear feet of new eight-inch sanitary sewer main (DIP), two fewer fire hydrant assemblies, 11 fewer sanitary sewer manholes and easements, are now needed to construct Project Nos. 22-WL-56 and 22-SL-122; and,
WHEREAS, the Map and Parcel information of the previously approved property has been modified to property located at 2362 E Zermatt Avenue and additional phasing has been added; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-085ES-002 on June 8, 2026, for revisions to the original mandatory referral; and,
WHEREAS, Ordinance No. BL2023-2028 provides that amendments to the legislation shall be approved by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Ordinance No. BL2023-2028 is hereby amended by deleting Section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to accept approximately 775 linear feet of new eight-inch water main (DIP), approximately 969 linear feet of new eight-inch sanitary sewer main (PVC), approximately 290 linear feet of new eight-inch sanitary sewer main (DIP), two fire hydrant assemblies, nine sanitary sewer manholes and easements, for property located at 2362 E Zermatt Avenue, also known as Rose Monte Phase 4-1, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the acceptance authorized by this resolution.
Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This amendment has been approved by the Planning Commission.
