WHEREAS, Ordinance No. BL2022-1082, approved February 16, 2022, authorized the abandonment of approximately 491 linear feet of existing 36 inch sanitary sewer main, approximately 660 linear feet of existing six inch water main, two sanitary sewer manholes, one fire hydrant assembly and easements, the relocation of one fire hydrant assembly, and the acceptance of approximately 15 linear feet of new eight inch sanitary sewer main, approximately 1,290 linear feet of new eight inch water main (DIP), one sanitary sewer manhole, three fire hydrant assemblies and easements, for two properties located at 801 12th Avenue North and 800 14th Avenue North, also known as Chartwell at Marathon Village; and,

WHEREAS, the acceptance of approximately 203 linear feet of new 18 inch sanitary sewer main (PVC) one additional new sanitary sewer manhole and easements, and the replacement of one fire hydrant assembly, are needed to construct MWS Project Nos. 21-SL-15 and 21-WL-10; and,

WHEREAS, the previously approved acceptance of approximately 90 linear feet of new eight inch water main (DIP), approximately 15 linear feet of new eight inch sanitary sewer main, one fire hydrant assembly and easements, is no longer needed to construct Project No. Nos. 21-SL-15 and 21-WL-10; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-004ES-001 on December 15, 2021 and No. 2022M-187ES-001 on January 12, 2023, for the abandonment, relocation, replacement, and acceptance of said sanitary sewer and water mains, sanitary sewer manholes, fire hydrant assemblies and easements.

WHEREAS, Ordinance No. BL2022-1082 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That Ordinance No. BL2022-1082 is hereby amended deleting section 1 in its entirety and replacing it with the following:

The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 491 linear feet of existing 36 inch sanitary sewer main, approximately 660 linear feet of existing six inch water main, two sanitary sewer manholes and easements, to replace one fire hydrant assembly, to relocate one fire hydrant assembly, and to accept approximately 203 linear feet of new 18 inch sanitary sewer main (PVC), approximately 1,200 linear feet of new eight inch water main (DIP), two sanitary sewer manholes, two fire hydrant assemblies and easements, for two properties located at 801 12th Avenue North and 800 14th Avenue North, also known as Chartwell at Marathon Village, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment, relocation, and acceptance authorized by this resolution.

Section 3.                     This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution amends Ordinance No. BL2022-1082 to accept approximately 203 linear feet of new 18-inch sanitary sewer main (PVC), one additional new sanitary sewer manhole and easements, and replace of one fire hydrant assembly. In addition, the acceptance of approximately 90 linear feet of new eight-inch water main (DIP), approximately 15 linear feet of new eight-inch sanitary sewer main, one fire hydrant assembly and easements are no longer needed to construct this project.

 

This resolution has been approved by the Planning Commission. Ordinance No. BL2022-1082 provided that future amendments to the ordinance may be made by resolution.

 

Fiscal Note: This ordinance has no cost to Metro. Donated easements have no market value according to the Department of Metro Water Services.
