WHEREAS, Ordinance No. O98-1037 created a Central Business Improvement District for downtown Nashville (the “Downtown CBID”), which was subsequently renewed by Ordinance Nos. BL2007- 1312 and BL2017-580; and

WHEREAS, Ordinance No. BL2006-1123 created a separate Central Business Improvement District for the Gulch area of Nashville (the “Gulch CBID”), which was subsequently renewed by Ordinance No. BL2015-67; and

WHEREAS, pursuant to Ordinance No. BL2015-67, the Gulch CBID will expire and terminate effective as of December 31, 2026; and

WHEREAS, pursuant to T.C.A. § 7-84-511, the local governing body of a metropolitan government has the authority to initiate the creation of a central business improvement upon the adoption of a resolution and to enact an ordinance establishing the same after holding a public hearing; and

WHEREAS, the Metropolitan Council desires to initiate the process of re-establishing and increasing the size of the Downtown CBID and incorporating the area of the Gulch CBID into the Downtown CBID to replace the existing Gulch CBID upon its expiration on December 31, 2026; and

WHEREAS, T.C.A. § 7-84-513 provides that upon adopting an initiating resolution for a central business improvement district, the governing body shall order a public hearing to determine whether such central business improvement district shall be established, which hearing must be held not less than 30 nor more than 45 days following the adoption of the initiating resolution; and

WHEREAS, the creation of an expanded Downtown CBID will enhance the local business climate and help manage the area to ensure that it is clean, safe, and vibrant, and will attract more people to live, work, play, and invest in the greater downtown Nashville area; and

WHEREAS, among the services and improvements to be funded by the Downtown CBID will be cleaning and safety enhancements, beautification efforts, business, residential and retail recruitment and retention services, and overall promotions of downtown.

 

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

 

Section 1. Pursuant to the Central Business Improvement District Act of 1990, T.C.A. § 7-84-501, et seq., the Metropolitan Council hereby initiates the process for establishing an expanded Downtown CBID.

 

Section 2. The name of the district will be the Downtown Central Business Improvement District.

 

Section 3. The boundaries of the Downtown CBID will be as follows:

 

A.                     From and after the effective date of the ordinance creating the expanded Downtown CBID, the boundaries of the Downtown CBID will be as follows:

With an eastern boundary centerline of the Cumberland River from James Robertson Parkway to the eastern boundary of parcels east of Lea Avenue. The southern boundary is from the Cumberland River, the eastern boundary of parcels east of Lea Avenue to Hermitage Avenue; continuing along the centerline of Lea Avenue from Hermitage Avenue to Lafayette Street; thence the centerline of Lafayette Street northwest to 7th Ave. S.  Proceed south to the intersection of 7th Ave South and Drexel Street. Then, continue west on Drexel St to 8th Ave S.; with the centerline of 8th Avenue S southward to Gleaves Street and its intersection of CSX railroad. The western boundary is the centerline of the CSX RR from Gleaves Street to Broadway. Along the centerline of Broadway southwest to the intersection of George L. Davis Blvd.  Continuing along the centerline of George L Davis Blvd northward to the intersection of Josephine Holloway Ave.  Continuing along the western lines of parcels 09204039000 and 09204033700 to the CSX railroad.  Thence, northeast to Harrison Street continue to Rosa L. Parks Blvd. Thence southward along the centerline of Rosa L. Parks Blvd to the intersection of Dr. Martin L. King Jr. Blvd. Along the centerline of Dr. Martin L. King Jr. Blvd to the intersection of 11th Ave. N.  Continuing along the centerline of 11th Ave N. to the intersection of Broadway centerline of Broadway to of 10th Avenue to the centerline northern boundary of parcels along Broadway to 9th Avenue N; centerline of 9th Avenue N to Union Street; centerline of Union Street to 6th Avenue N; centerline of 6th Avenue N to Charlotte Avenue; centerline of Charlotte Avenue to 3rd Avenue N; centerline of 3rd Avenue N to James Robertson Parkway; centerline of James Robertson Parkway to the Cumberland River; plus the addition of the two parcels of property located between 9th Avenue N. and YMCA Way, being Parcel Nos. 09305016100 and 09305016000.

 

B.                     From and after January 1, 2027, the boundaries of the Downtown CBID shall be as follows:

With an eastern boundary centerline of the Cumberland River from James Robertson Parkway to the eastern boundary of parcels east of Lea Avenue. The southern boundary is from the Cumberland River, the eastern boundary of parcels east of Lea Avenue to Hermitage Avenue; continuing along the centerline of Lea Avenue from Hermitage Avenue to Lafayette Street; thence the centerline of Lafayette Street northwest to 7th Ave. S.  Proceed south to the intersection of 7th Ave South and Drexel Street. Then, continue west on Drexel St to 8th Ave S.; with the centerline of 8th Avenue S southward to Gleaves Street and its intersection of CSX railroad. thence southeasterly along the western boundary of the CSX Railroad Right-of-Way to the intersection of Interstate 40 W, proceeding generally northwesterly along the eastern boundary of the Interstate 40 W to the CSX railroad.  Thence, northeast to Harrison Street continue to Rosa L. Parks Blvd. Thence southward along the centerline of Rosa L. Parks Blvd to the intersection of Dr. Martin L. King Jr. Blvd. Along the centerline of Dr. Martin L. King Jr. Blvd to the intersection of 11th Ave. N.  Continuing along the centerline of 11th Ave N. to the intersection of Broadway centerline.  Continuing along Broadway to 10th Avenue N., to the northern boundary of parcels along Broadway to 9th Avenue N; along 9th Avenue N to Union Street; with the centerline of Union Street to 6th Avenue N; centerline of 6th Avenue N to Charlotte Avenue; centerline of Charlotte Avenue to 3rd Avenue N; centerline of 3rd Avenue N to James Robertson Parkway; centerline of James Robertson Parkway to the Cumberland River; plus the addition of the two parcels of property located between 9th Avenue N. and YMCA Way, being Parcel Nos. 09305016100 and 09305016000.

 

Section 4. The improvements, services, projects proposed for the Downtown CBID, and other proposed uses of the special assessment revenues, will generally include the following:

1.                     Maintenance and cleaning services;

2.                     Beautification efforts;

3.                     Safety and hospitality services;

4.                     Streetscape and landscape programs;

5.                     Communications and marketing, district advocacy, and district management;

6.                     Business, resident, and retail recruitment; and

7.                     Such other services as are authorized by Tennessee Code Annotated § 7-84-520.

Section 5. The estimated cost of the initially proposed improvements, services projects and other permitted uses of special assessment revenues is $8,014,963.

Section 6. The initial rate of levy of the special assessment for the Downtown CBID, based on December 31, 2024, records of the metropolitan assessor of property, will be $0.001294 per dollar of assessed property value.

 

Section 7. That at the meeting of the Metropolitan Council to be held on Tuesday, July 15, 2025, at 6:30 p.m. in the Metropolitan Council Chamber in the Metropolitan Courthouse (One Public Square), the Council shall conduct a public hearing relative to creating the Downtown CBID as provided herein, at which hearing any person desiring to be heard regarding the matter will be afforded such an opportunity.

 

Section 8. That the Metropolitan Clerk is hereby directed to have published a notice of the public hearing once a week for three consecutive weeks in a newspaper of general circulation. Such notice shall state in summary detail those facts provided in this initiating resolution. The notice shall state the time and place of such public hearing. 

 

Section 9. This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government requiring it.

This resolution initiates the creation of an expanded Downtown Central Business Improvement District (“Downtown CBID”) and sets a public hearing.

 

The Downtown CBID was created in 1998 by Ordinance No. O98-1037 with an expiration date of December 31, 2007. Ordinance No. BL2007-1312 renewed the CBID, extending the expiration date to December 31, 2017. Ordinance No. BL2017-580 extended the Downtown CBID indefinitely.

 

The Gulch CBID was created in 2006 through Ordinance No. BL2006-1123, which was subsequently renewed by Ordinance No. BL2015-67. The Gulch CBID is set to expire and terminate on December 31, 2026.

 

The intention of this resolution and the related Ordinance No. BL2025-846 on First Reading is to expand the Downtown CBID to incorporate the Gulch CBID upon its expiration.

 

The resolution under consideration would initiate the process for establishing an expanded Downtown CBID, pursuant to Tenn. Code Ann. § 7-84-501 et seq. State law provides that a public hearing must be held not less than 30 nor more than 45 days following the adoption of the initiating resolution.

 

The public hearing, required by state law, would be held on July 15, 2025, at 6:30pm in the Metropolitan Council Chamber.
