A resolution authorizing The Metropolitan Government of Nashville and Davidson County to abandon a fire hydrant assembly, and to accept new public water and sanitary sewer mains, fire hydrant assembly and sanitary sewer manholes, for property located at 1245 Kenmore Place, (MWS Project Nos. 25-WL-44 and 25-SL-108 and Proposal No. 2025M-139ES-001).

WHEREAS, the abandonment of one fire hydrant assembly, and the acceptance of approximately 108 linear feet of new six-inch water main (DIP), approximately 110 linear feet of new eight-inch sanitary sewer main (SDR 35), one fire hydrant assembly and two sanitary sewer manholes, for property located at 1245 Kenmore Place, are needed to construct project numbers 25-WL-44 and 25-SL-108; and,
WHEREAS, BL2024-345 authorizes the Metropolitan Department of Water and Sewerage Services to approve extensions, additions, improvement, or works by resolution of the Metropolitan Council; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2025M-139ES-001 on September 9, 2025, for the abandonment and acceptance of said water and sanitary sewer mains, fire hydrant assemblies and sanitary sewer manholes.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon one fire hydrant assembly, and to approximately 108 linear feet of new six-inch water main (DIP), approximately 110 linear feet of new eight-inch sanitary sewer main (SDR 35), one fire hydrant assembly and two sanitary sewer manholes, for property located at 1245 Kenmore Place, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.
Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Tennessee Code Annotated section 7-35-406(a)(2) and Ordinance No. BL2024-345 allow the Metropolitan Department of Water and Sewerage Services to approve extensions, additions, or works by resolution of the Metropolitan Council.
This proposal has been approved by the Planning Commission.
