WHEREAS, TDOT plans to construct a road improvement project to replace signage, widen existing shoulders, replace culverts, and improve safety features on Nolensville Pike, from Haywood Lane to McNally Drive; and,

WHEREAS, as described in the proposal attached hereto in duplicate and incorporated herein by reference, the Metropolitan Government, by and through NDOT, agrees to cooperate with TDOT so that said construction can occur; and,

WHEREAS, Tennessee Code Annotated Section 12-9-104(a)(2)(b) authorizes the Metropolitan Council to approve an agreement with TDOT by resolution; and,

WHEREAS, it is in the best interest of the Metropolitan Government of Nashville and Davidson County that this construction be carried out on State Project No. 19028-0252-94, 19028-1252-94, 19028-2252-94, 19028-3252-94; PIN 125526.15.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.    That the proposal of TDOT to the Metropolitan Government of Nashville and Davidson County, acting by and through NDOT, for NDOT to maintain traffic control devices in connection with TDOT’s pedestrian and signal improvement project on State Route 11 (Nolensville Pike), from Haywood Lane to McNally Drive, attached hereto in duplicate and incorporated herein by reference, is hereby approved, and that the Metropolitan Mayor is authorized to execute the same.

Section 2.    That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves an agreement between the Tennessee Department of Transportation (“TDOT”) and the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”) for the maintenance of traffic control devices in connection with TDOT’s pedestrian and signal improvement project on State Route 11 (Nolensville Pike), from Haywood Lane to McNally Drive. TDOT will be responsible for all design, right-of-way, and construction services for this project.

 

State law authorizes the Metropolitan Government to approve intergovernmental agreements by resolution.

 

Fiscal Note: TDOT will be responsible for the all design, right-of-way, and construction services for the pedestrian and signal improvement on SR-11 from Haywood Lane to McNally Drive and Metro will be responsible for the maintenance.
