WHEREAS, the City of Belle Meade owns, operates, and maintains traffic signalization equipment (the “Signal Equipment”) at the intersection of Harding Place and Belle Meade Boulevard, the “Intersection”), within the corporate boundaries of Belle Meade; and,

WHEREAS, as set forth in the interlocal agreement attached hereto as “Exhibit A”, NDOT and Belle Meade agree that the Signal Equipment at the Intersection, along with the entire Intersection itself, should be redesigned and reconstructed to enhance both safety and efficiency for roadway users of all modes (the “Project”); and,

WHEREAS, as set forth in Exhibit A, NDOT has agreed to manage the design and construction of the Project through existing Indefinite Delivery/Indefinite Quantity contracts; and,

WHEREAS, as set forth in Exhibit A, the City of Belle Meade has agreed to be responsible for all costs and expenses associated with the design and construction of the Project; and,

WHEREAS, Tennessee Code Annotated Section 12-9-101, et seq. authorizes public agencies in this state to enter interlocal cooperation agreements; and,

WHEREAS, it is in the interest of the citizens of the Metropolitan Government of Nashville and Davidson County that this interlocal agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1:                     That the interlocal agreement between the City of Belle Meade and the Metropolitan Government of Nashville and Davidson County, by and through NDOT, attached hereto as “Exhibit A” and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute same.

Section 2.                       Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3.                     That this resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves an interlocal agreement between the City of Belle Meade and the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”).

 

Pursuant to the terms of the agreement, NDOT and the City of Belle Meade would agree that the traffic signalization equipment at the intersection of Harding Place and Belle Meade Boulevard, which is owned, operated, and maintained by the City of Belle Meade and is within the corporate boundaries of the City of Belle Meade, would be redesigned and reconstructed to enhance safety and efficiency for all roadway users. NDOT would manage the design and construction of the traffic signal improvement project. NDOT would use existing Indefinite Delivery/Indefinite Quantity Contracts to complete the project. The City of Belle Meade would have final approval of the design prior to construction. The City of Belle Meade would be responsible for all costs and expenses associated with the design and construction and must allow NDOT access to regularly inspect the traffic signalization equipment.

 

The term of the agreement would begin upon approval of the Council and extend through December 31, 2033. Either party may terminate the agreement upon 30 days’ written notice to the other party.

 

Fiscal Note: According to the recitals of the agreement, the City of Belle Meade would fund the estimated cost of $30,000 for traffic engineering services and $550,000 for installation of traffic signals and control devices related to the traffic signal and intersection improvement project at the intersection of Harding Place and Belle Meade Boulevard.
