A resolution authorizing The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, to enter into a Construction Agreement and six Pipeline Crossing License Agreements with R.J. Corman Railroad Company/Nashville & Eastern Railroad Line, to develop six pipeline encroachments and construct and maintain six pipelines for waste, raw and finished water in the railroad right-of-way at 1400 Pumping Station Road and Pumping Station Road (unnumbered) in Davidson County, (Project No. 21-WC-0121 and Proposal No. 2025M-008AG-001).

WHEREAS, the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services (“Metro”) desires to facilitate the development of six proposed pipeline encroachments along Omohundro Drive from MP 3.1 - 3.28 on property controlled by R.J. Corman Railroad Company/Nashville and Eastern Railroad Line (“R.J. Corman”), pursuant to the terms of the Construction Agreement (NERR25005), attached hereto in substantial form as Exhibit 1; and,
WHEREAS, Metro desires to construct and maintain, six, separate pipelines solely for the transmission of waste, raw, or finished water under or over the track(s) and property owned or controlled by R.J. Corman, pursuant to the terms of the Pipeline Crossing License Agreements (RJNE24046 - RJNE24051), attached hereto in substantial form as Exhibits 2-7; and,
WHEREAS, Ordinance No. O98-1364 authorized The Metropolitan Government of Nashville and Davidson County to enter these types of agreements with Nashville and Eastern Railroad, now a part of R. J. Corman Railroad company, for water and sewer line construction by resolution; and,
WHEREAS, approval of these agreements will benefit the citizens of The Metropolitan Government of Nashville and Davidson County.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Construction Agreement and Pipeline Crossing License Agreements, attached hereto in substantial form as Exhibits 1-7 and incorporated herein by reference, are hereby approved, and that the Metropolitan Mayor is authorized to execute the same.
Section 2. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves a construction agreement and six pipeline crossing license agreements between R.J. Corman Railroad Company/Nashville & Eastern Railroad Line (“RJC”) and the Metropolitan Department of Water and Sewerage Services (“MWS”) to develop six pipeline encroachments and construct and maintain six pipelines for waste, raw, and finished water in the railroad right-of-way at 1400 Pumping Station Road and Pumping Station Road (unnumbered) in Davidson County.
Pursuant to the terms of the construction agreement, MWS would prepare all documents related to the design and construction of the project for the development of six pipeline encroachments. RJC will review and approve the plans. MWS will install the six pipelines and traffic control. RJC will perform, or cause to be performed, preliminary engineering and construction engineering and flagging services.
Pursuant to the terms of the six pipeline crossing license agreements, MWS would construct and maintain six, separate pipelines solely for the transmission of waste, raw, or finished water under or over tracks and property owned or controlled by RJC.
