NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:
By amending a Planned Unit Development Overlay District on property located at 5001 and 5003 Gallatin Pike, approximately 135 feet south of Joyce Lane, zoned MUL-A (0.90 acres), to permit nonresidential uses including a drive-through restaurant, being Property Parcel Nos. 149-150 as designated on Map 061-03 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the attached sketch, which is attached to and made a part of this ordinance as though copied herein.

Section 3. Be it further enacted, that the uses of this Planned Unit Development Overlay District shall be limited to retail, restaurant, personal care services, office, and medical office uses; additional uses will require approval by Council.
Section 4. Be it further enacted that the following conditions shall be completed, bonded or satisfied as specifically required:
1. With approval of the PUD amendment, the overall square footage in the PUD is limited to a maximum of 6,250 square feet.
2. Shared access at the southeastern property line is not approved. As Metro does not have conceptual design for the Gallatin All Access Corridor, the applicant with submittal of their final site plan, shall work with applicable Metro Departments to review and analyze their plans to make a final determination as to the appropriateness of the entrance.
3. If the shared access location is permitted by Planning and NDOT, documentation of a recorded access easement must be provided prior to approval of the final site plan.
4. With the final site plan, the landscaping plan shall include street trees along Joyce Lane.
5. On the corrected copy, all references and standards of a UDO shall be removed as they are not applicable to the subject property.
6. Comply with all conditions and requirements of Metro Reviewing Agencies.
7. This approval does not include any signs. Signs in planned unit developments must be approved by the Metro Department of Codes Administration except in specific instances when the Metro Council directs the Metro Planning Commission to review such signs.
8. The requirements of the Metro Fire Marshal’s Office for emergency vehicle access and adequate water supply for fire protection must be met prior to the issuance of any building permits.
