WHEREAS, Metropolitan Charter Section 10.104 provides that the Board of Health has the duty to contract for such services as will further the program and policies of the Board, subject to confirmation by Resolution of Council; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and the State of Tennessee, Tennessee Department of Health, wish to enter into a data use agreement for the Metropolitan Public Health Department to access certain vital records data to support its public health surveillance and response; and, 

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this contract be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That the data use agreement between the State of Tennessee, Tennessee Department of Health, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to access certain vital records data to support its public health surveillance and response, a copy of which is attached hereto and incorporated herein, is hereby approved.   

 Section 2.                     That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Analysis

 

This resolution approves a data use agreement between the Tennessee Department of Health (“TDH”) and the Metropolitan Board of Health (“Metro Health”) to access certain vital records data to support the TDH’s public health surveillance and response.

 

The agreement would allow TDH’s Office of Vital Records to share with Metro Health all finalized birth, finalized death, and finalized fetal death data from 2022 until 2030 and all finalized linked birth infant death data from 2021 until 2029. All requested data must be evaluated for confidentiality and comply with any applicable state and federal law. All data must be used by Metro Health for research and conduct of official duties

 

The term of the agreement is three years from the date that all parties sign the contract.

 

Metropolitan Charter section 10.104 states that the Metropolitan Board of Health shall contract for services to further the program and policies of the Board, subject to Metropolitan Council approval by resolution.

 

Fiscal Note: There is no cost to Metro for the performance of this agreement.
