A resolution to amend Ordinance No. BL2022-1418 to authorize The Metropolitan Government of Nashville and Davidson County to accept additional sanitary sewer manhole, to modify sanitary sewer main and associated easements, for three properties located at 2135 and 2141 Waterside Drive and 2200 Bowline Avenue, also known as The Landings at River North (MWS Project Nos. 20-WL-23 and 20-SL-41, and Proposal Nos. 2022M-110ES-001 and 2023M-063ES-001).

WHEREAS, Ordinance No. BL2022-1418, approved October 5, 2022, authorized the acceptance of approximately 1,078 linear feet of new eight-inch water main (DIP), approximately 375 linear feet of new 10-inch sanitary sewer main (DIP), approximately 554 linear feet of new 10-inch sanitary sewer main (PVC), one fire hydrant assembly, six sanitary sewer manholes and easements, and the relocation of one fire hydrant assembly, for three properties located at 2135 and 2141 Waterside Drive and 2200 Bowline Avenue, also known as The Landings at River North; and,
WHEREAS, the acceptance of approximately 258 linear feet of new eight-inch sanitary sewer main (PVC), one additional sanitary sewer manhole and easements, is needed to construct Project No. 20-SL-41; and,
WHEREAS, the previously approved acceptance of approximately 270 linear feet of 10-inch sanitary sewer main (PVC), is no longer needed to construct Project No. 20-SL-41; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-110ES-001 on July 29, 2022, for acceptance and relocation of said water and sanitary sewer mains, fire hydrant assemblies, sanitary sewer manholes and easements and approved mandatory referral No. 2023M-063ES-001 on April 17, 2023, for revisions to the original mandatory referral; and,
WHEREAS, Ordinance No. BL2022-1418 provides that amendments to the legislation shall be approved by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Ordinance No. BL2022-1418 is hereby amended by deleting Section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to accept approximately 1,078 linear feet of new eight-inch water main (DIP), approximately 258 linear feet of new eight-inch sanitary sewer main (PVC), approximately 375 linear feet of new 10-inch sanitary sewer main (DIP), approximately 284 linear feet of new 10-inch sanitary sewer main (PVC), one new fire hydrant assembly, seven new sanitary sewer manholes and easements, and to relocate one fire hydrant assembly, for three properties located at 2135 and 2141 Waterside Drive and 2200 Bowline Avenue, also known as The Landings at River North, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the acceptance and relocation authorized by this resolution.
Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution amends BL2022-1418 to accept 258 linear feet of new eight-inch sanitary sewer main (PVC), one additional sanitary sewer manhole and easements. It has been determined that previously approved acceptance of approximately 270 linear feet of 10-inch sanitary sewer main (PVC) is no longer needed to construct this project.
This has been approved by the Planning Commission.
