A resolution authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer main and sanitary sewer manhole, and to accept new public sanitary sewer main and sanitary sewer manholes, for property located at 1309 5th Avenue North, also known as 5th & Monroe Townhomes (MWS Project No. 23-SL-139 and Proposal No. 2024M-084ES-001).

WHEREAS, the abandonment of approximately 110 linear feet of existing eight-inch sanitary sewer main (VCP) and one sanitary sewer manhole, and the acceptance of approximately 165 linear feet of new eight-inch sanitary sewer main (PVC) and three new sanitary sewer manholes, for property located at 1309 5th Avenue North, also known as 5th & Monroe Townhomes, are needed to construct project number 23-SL-139; and,
WHEREAS, BL2024-345 authorizes the Metropolitan Department of Water and Sewerage Services to approve extensions, additions, improvement, or works by resolution of the Metropolitan Council; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2024M-084ES-001 on June 24, 2024, for the abandonment and acceptance of said sanitary sewer mains and sanitary sewer manholes.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 110 linear feet of existing eight-inch sanitary sewer main (VCP) and one sanitary sewer manhole, and to accept approximately 165 linear feet of new eight-inch sanitary sewer main (PVC) and three new sanitary sewer manholes, for property located at 1309 5th Avenue North, also known as 5th & Monroe Townhomes, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.
Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Tennessee Code Annotated § 7-35-406(a)(2) and Ordinance No. BL2024-345 allows the Metropolitan Department of Water and Sewerage Services to approve extensions, additions, or works by resolution of the Metropolitan Council.
