A resolution to amend Ordinance No. BL2019-1714 to authorize The Metropolitan Government of Nashville and Davidson County to abandon existing utility easement rights, for property located at 2501 Clifton Avenue (MWS Project No. 18-WL-55 and Proposal No. 2019M-048ES-002).

WHEREAS, Ordinance No. BL2019-1714, approved July 17, 2019, authorized the abandonment of approximately 198 linear feet of existing six inch water main (cast iron), approximately 390 linear feet of existing six inch water main (DIP), and one fire hydrant assembly, and the acceptance of approximately 248 linear feet of new 12 inch water main (DIP) and one fire hydrant assembly, for property located at 2501 Clifton Avenue; and,

WHEREAS, the abandonment of existing utility easement rights, retained by Ordinance No. BL2018-1250, approved July 18, 2018, is needed to construct project number 18-WL-55; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M-048ES-002 on April 7, 2021, for the abandonment of said utility easement rights; and,

WHEREAS, Ordinance No. BL2019-1714 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That Ordinance No. BL2019-1714 is hereby amended by deleting section 1 in its entirety and replacing it with the following:

The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 198 linear feet of existing six inch water main (cast iron), approximately 390 linear feet of existing six inch water main (DIP), one fire hydrant assembly and easements, and to accept approximately 248 linear feet of new 12 inch water main (DIP) and one fire hydrant assembly, for property located at 2501 Clifton Avenue, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution amends Ordinance No. BL2019-1714 to abandon utility easement rights that were retained for property located at 2501 Clifton Avenue. BL2019-1714 abandoned various water infrastructure for this property, but Ordinance No. BL2018-1250 retained existing easement rights. It is has now been determined that abandonment of the easement rights is necessary for completion of the project.

 

BL2019-1714 provided that future amendments could be approved by resolution.

 

This resolution has been approved by the Planning Commission.
