WHEREAS, the abandonment of approximately 75 linear feet of existing eight-inch sanitary sewer main (PVC), one fire hydrant assembly and one sanitary sewer manhole, and the acceptance of approximately 2,473 linear feet of new eight-inch water main, approximately 2,296 linear feet of new eight-inch sanitary sewer main (DIP), approximately 1,829 linear feet of new eight-inch sanitary sewer main (PVC), five fire hydrants assemblies and 30 sanitary sewer manholes, for property located at 5047 John Hagar Road, also known as Kingsley Park, are needed to construct project numbers 23-WL-39 and 23-SL-91; and,

WHEREAS, BL2024-345 authorizes the Metropolitan Department of Water and Sewerage Services to approve extensions, additions, improvement, or works by resolution of the Metropolitan Council; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2025M_132ES-001 on August 8, 2025, for the abandonment and acceptance of said water and sanitary sewer mains, fire hydrant assemblies and sanitary sewer manholes.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 75 linear feet of existing eight-inch sanitary sewer main (PVC), one fire hydrant assembly and one sanitary sewer manhole, and to accept approximately 2,473 linear feet of new eight-inch water main, approximately 2,296 linear feet of new eight-inch sanitary sewer main (DIP), approximately 1,829 linear feet of new eight-inch sanitary sewer main (PVC), five fire hydrants assemblies and 30 sanitary sewer manholes, for property located at 5047 John Hagar Road, also known as Kingsley Park, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.

Section 3.                     This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Tennessee Code Annotated section 7-35-406(a)(2) and Ordinance No. BL2024-345 allow the Metropolitan Department of Water and Sewerage Services to approve extensions, additions, or works by resolution of the Metropolitan Council.

 

This proposal has been approved by the Planning Commission.
