WHEREAS, Ordinance No. BL2023-125, approved January 24, 2024, authorized the abandonment of approximately 1,882 linear feet of existing six-inch water main (CI) and approximately 1,714 linear feet of existing 12-inch water main (CI), and the acceptance of approximately 1,263 linear feet of new 12-inch water main (DIP), approximately 39 linear feet of new 10-inch water main (DIP), approximately 121 linear feet of new eight-inch water main (DIP), approximately 135 linear feet of new six-inch water main (DIP), and three fire hydrant assemblies, for property located at 1215 21st Avenue South, also known as VUMC Link Tower; and,

WHEREAS, the abandonment of approximately 154 linear feet of existing eight-inch water main (CI), approximately 47 linear feet of existing 10-inch water main (CI), an additional 80 linear feet of existing 12-inch water main (CI), and three fire hydrant assemblies, and the acceptance of an additional 42 linear feet of new 12-inch water main (DIP), for property located at 1215 21st Avenue South, also known as VUMC Link Tower, are needed to construct project number 23-WL-71; and,

WHEREAS, the abandonment of approximate 79 linear feet of existing six-inch water main (CI), is no longer needed to construct project number 23-WL-71; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-159ES-003 on May 17, 2024, for revisions to the original mandatory referral; and,

WHEREAS, Ordinance No. BL2023-125 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That Ordinance No. BL2023-125 is hereby amended deleting section 1 in its entirety and replacing it with the following:

The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 1803 linear feet of existing six-inch water main (CI), approximately 154 linear feet of existing eight-inch water main (CI), approximately 47 linear feet of existing 10-inch water main (CI), approximately 1,794 linear feet of existing 12-inch water main (CI) and three fire hydrant assemblies, and to accept approximately 137 linear feet of new six-inch water main (DIP), approximately 122 linear feet of new eight-inch water main (DIP), approximately 40 linear feet of new 10-inch water main (DIP), approximately 1,305 linear feet of new 12-inch water main (DIP) and three fire hydrant assemblies, for property located at 1215 21st Avenue South the VUMC Link Tower, Revision 1, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.

Section 3.                     This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Ordinance No. BL2023-125 was approved by the Metropolitan Council on January 24, 2024. The legislation authorized the abandonment of approximately 1,882 linear feet of existing six-inch water main (CI) and approximately 1,714 linear feet of existing 12-inch water main (CI), and the acceptance of approximately 1,263 linear feet of new 12-inch water main (DIP), approximately 39 linear feet of new 10-inch water main (DIP), approximately 121 linear feet of new eight-inch water main (DIP), approximately 135 linear feet of new six-inch water main (DIP), and three fire hydrant assemblies, for property located at 1215 21st Avenue South, also known as VUMC Link Tower. BL2023-125 provided that amendments to the ordinance may be approved by resolution.

 

The resolution under consideration amends this legislation to abandon approximately 154 linear feet of existing eight-inch water main (CI), approximately 47 linear feet of existing 10-inch water main (CI), an additional 80 linear feet of existing 12-inch water main (CI), and three fire hydrant assemblies, and accept an additional 42 linear feet of new 12-inch water main (DIP). Also, the previously approved of approximate 79 linear feet of existing six-inch water main (CI), is no longer needed to complete the project and would be removed from the ordinance.

 

These changes have been approved by the Planning Commission.
