This Agreement is entered into on this _____ day of _____________, 2024, by, between, The Metropolitan Nashville Department of Communications, a department of THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, a metropolitan government organized and existing under the laws and constitution of the State of Tennessee (hereinafter "Metro"), and the FAIRFAX COUNTY DEPARTMENT OF PUBLIC SAFETY COMMUNICATIONS, a county entity organized and existing under the laws and Constitution of the Commonwealth of Virginia (hereinafter "DPSC") (collectively the “Parties”).
WHEREAS, both The Metropolitan Nashville Department of Communications (“Metro DEC”), Government of Nashville and Davidson County (“Metro”), and The County of Fairfax, Virginia County Department of Public Safety (“Fairfax”), (“the Parties”) are engaged in providing emergency services as an E9-1-1 Public Safety Answering Point (“PSAP”) through their emergency communication departments - the Metropolitan Department of Emergency Communications (“Metro DEC”) and the Fairfax County Department of Public Safety Communications (“Fairfax”), respectively; and,
WHEREAS, each Party understands that the concept of the Emergency E9-1-1 system is to provide for the prompt answering and dispatching of emergency calls for assistance by the public; and,
WHEREAS, the Parties desire to work together to provide backup capability for the safety of residents and visitors in each jurisdiction, and the emergency response personnel within; and,
WHEREAS, Metro DEC and Fairfax (collectively referred to as the “Network Users”) are customers of the AT&T Next Generation ESINet (hereinafter the "Network"); and
WHEREAS, the State of Tennessee and the DPSC maintain contracts for Next Generation Core Services (NGCS) with an NGCS Service Provider to maintain said Network; and
WHEREAS, Metro DEC has a precedent working with neighboring public safety communications entities to share a digital/analog 700/800 MHz Motorola Radio System and non-emergency voice and data; and
WHEREAS, Metro DEC and Fairfax are tasked with providing public safety solutions to enhance dispatching services and improve response for their respective jurisdictions; and
WHEREAS, Metro DEC and Fairfax can deploy cloud-hosted computer aided dispatch solutions capable of sharing requests for service used for public safety purposes to enhance call delivery, call handling, and dispatching services to ultimately improve emergency response; and
WHEREAS, Metro DEC and Fairfax wish to interoperate with each other’s networks, enhancing Metro’s and DPSC ability to share data to enhance call delivery, call handling, and dispatching services to ultimately improve emergency response; and
WHEREAS, T.C.A., section 12-9-101, et seq., grants to public agencies in Tennessee the authority to enter into interlocal agreements to achieve common objectives subject to the approval of their respective governing bodies by resolution; and
WHEREAS, Metro DEC and Fairfax desire to enter into the attached Mutual Aid Agreement (attached), to further these efforts.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1. The Mutual Aid Agreement between The Metropolitan Nashville Department of Communications (“Metro DEC”) Government of Nashville and Davidson County and The County of Fairfax, Virginia County Department of Public Safety (“Fairfax”), attached hereto and incorporated herein, is hereby approved.
SECTION 2. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
IN WITNESS WHEREOF, the authorized representatives of the parties have affixed their signatures below with the intent to make this Agreement effective as of the date first written above.

This resolution approves an intergovernmental mutual aid agreement between the Metropolitan Government and Fairfax County, Virginia for the benefit of their respective Department of Emergency Communications and Department of Public Safety Communications.
Tennessee Code Annotated § 12-9-101 et seq. authorizes public agencies in Tennessee to enter into interlocal cooperation agreements with other localities by resolution.
The purpose of this agreement is to provide reciprocal backup 9-1-1 call handling and documentation in the event of a telecommunications disruption or outage that prevents the other party from receiving its 9-1-1 calls. The term of the agreement takes effect upon execution and extends for a term of five years, unless terminated upon 30 days written notice to the other party.
Fiscal Note: There is no cost to Metro for the performance of this mutual aid agreement with Fairfax County Department of Public Safety Communications to provide a reciprocal backup 9-1-1 call handling and documentation in the event of outage and disruption of the telecommunication system.
