WHEREAS, the abandonment of approximately 670 linear feet of existing 12 inch sanitary sewer main, two sanitary sewer manholes and easement, and the construction of approximately 660 linear feet of new 12 inch sanitary sewer mains (DIP) and five sanitary sewer manholes, for property located at 28th Avenue North (unnumbered), are needed to construct Project No. 22-SG-06; and,

WHEREAS, the negotiation and acceptance of permanent and temporary easements, for property located at 28th Avenue North (unnumbered), are also needed to construct Project No. 22-SG-06; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-154ES-001 on October 13, 2022, for the abandonment and construction of said sanitary sewer mains and sanitary sewer manholes and for the negotiation and acceptance of temporary and permanent easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 670 linear feet of existing 12 inch sanitary sewer main, two sanitary sewer manholes and easement, to construct approximately 660 linear feet of new 12 inch sanitary sewer mains (DIP) and five sanitary sewer manholes, and to negotiate and accept permanent and temporary easements, for property located at 28th Avenue North (unnumbered), as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment, construction, and negotiation and acceptance authorized by this ordinance.

Section 3.                     All necessary and incidental cost of the temporary and permanent easements herein authorized to be accepted shall be paid from funds authorized from Fund No. 47335 SIR/Capital Plan #142.

Section 4.                     Amendments to this legislation shall be approved by resolution.

Section 5.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance has been approved by the Planning Commission. Future amendments to this ordinance may be approved by resolution.

 

Fiscal Note: This ordinance has no cost to Metro. Abandoned and donated easements have no market value according to the Department of Water Services.
