WHEREAS, as described in the facility encroachment agreement attached hereto as Exhibit 1 and incorporated by reference herein, the Metropolitan Government, by and through the Department of Information Technology Services (ITS), wishes to construct, use, and maintain one 144-count aerial fiber optic crossing, solely for the transmission of voice communication or other data, via an optical waveguide, through a solid core of glass or plastic fiber material, at or near CSX’s Antioch Subdivision (“the Project”); and,
WHEREAS, BL2005-787 authorized the Metropolitan Council to approve by resolution agreements between the Metropolitan Government and CSX pertaining to permissions for bridge and/or roadway projects in which the Department of Public Works (now known as the Department of Transportation and Multimodal Infrastructure (NDOT)) participates; and,
WHEREAS, NDOT will be participating in the Project in that the Project will provide network redundancy for NDOT traffic cabinets on Murfreesboro Pike and Nolensville Pike, and NDOT will provide lane closure permits for the Project; thus, approval of this agreement by resolution of the Metropolitan Council is appropriate; and,
WHEREAS, it is in the interest of the Metropolitan Government of Nashville and Davidson County that this agreement be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the facility encroachment agreement between CSX Transportation, Inc. and the Metropolitan Government of Nashville and Davidson County, by and through the Department of Information Technology Services, attached hereto as Exhibit 1 and incorporated by reference herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. That any amendments, renewals, or extensions of the term of the agreement may be approved by resolution of the Metropolitan Council.
Section 3. That this resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This resolution authorizes the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”) to enter into a facility encroachment agreement with CSX Transportation, Inc. (“CSX”).
The agreement allows NDOT to construct, use, and maintain one 144-count aerial fiber optic crossing, solely to transmit voice communication or other data through glass or plastic fiber material at or near a subdivision owned by CSX in Antioch. NDOT would pay a one-time nonrefundable encroachment fee of $6,750.
Fiscal Note: Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”) will pay a one-time nonrefundable encroachment fee in the amount of $6,570 to CSX Transportation, Inc. to construct an aerial fiber optic crossing through a solid core of glass or plastic fiber material.
NDOT will be responsible for any cost incurred during and after the project’s construction.
