An ordinance approving an option agreement between the Metropolitan Government of Nashville and Davidson County and Jason Oggs and James Brown, authorizing the purchase of certain properties owned by Jason Oggs and James Brown (Parcel Nos. 07004018900, 07004018800, 07004010400) (Proposal No. 2024M-011AG-001).

WHEREAS, the Metropolitan Government of Nashville and Davidson County and Jason Oggs and James Brown desire to enter into an Option Agreement, attached hereto and incorporated herein as Exhibit 1, pertaining to certain properties (“the Properties”) owned by Jason Oggs and James Brown, located at 2312 Whites Creek Pike (Parcel No. 07004018900), 2314 Whites Creek Pike (Parcel No. 07004018800), 2316 Whites Creek Pike (Parcel No. 07004010400); and,
WHEREAS, the appraised value of the Properties exceeds the purchase price stated in the Option Agreement; and,
WHEREAS, the Metropolitan Nashville Department of Transportation and the Director of Public Property both recommend approval of the acquisition of the Property; and,
WHEREAS, acquiring the Properties will enable construction of a portion of a new collector street which is planned for the West Trinity area; and,
WHEREAS, approval of the Option Agreement and authorizing the Director of Public Property to purchase said Properties is in the best interest of the citizens of the Metropolitan Government.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:
Section 1. The Option Agreement attached hereto, between the Metropolitan Government of Nashville and Davidson County and Jason Oggs and James Brown, granting the Metropolitan Government an option to purchase the Properties located at 2312 Whites Creek Pike (Parcel No. 07004018900), 2314 Whites Creek Pike (Parcel No. 07004018800), 2316 Whites Creek Pike (Parcel No. 07004010400), is hereby approved.
Section 2. The Director of Public Property Administration, or his designee, is hereby authorized to execute and record such documents as may be necessary to carry out the purchase of said Properties in substantially the form of the Option Agreement attached hereto.
Section 3. This ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance approves an option agreement between the Metropolitan Government and Jason Oggs and James Brown. The option agreement would permit the Metropolitan Government to purchase the properties located at 2312 Whites Creek Pike, 2314 Whites Creek Pike, and 2316 Whites Creek Pike. If the option is exercised, the Metropolitan Government would pay the fair market value of $599,000 for these three properties, which consist of a total of 1.33 acres. Acquiring the properties would enable the Metropolitan Government to construct of a portion of a new collector street which is planned for the West Trinity area.
This proposal has been approved by the Planning Commission.
