WHEREAS, Ordinance No. BL2024-628 approved a participation agreement between The Metropolitan Government of Nashville and Davidson County (“Metro”) and Sojourn Nolensville Apartments, LP (the “Developer”) as part of the Housing Division of the Metropolitan Planning Department’s Connecting Housing to Infrastructure Program (“CHIP”) for the construction of pedestrian signaling and crossing near the intersection of Nolensville Pike and Taylor Rd to serve the development at 4420 Taylor Rd and the community; and,

WHEREAS, Metro and Developer now wish to amend the scope of the agreement by modifying the pedestrian crossings to be constructed and increasing Metro’s level of participation from $178,023.52 to $217,545, as further described in Amendment 1, attached hereto; and,

WHEREAS, Ordinance No. BL2024-628 provides that amendments to the legislation may be approved by resolution; and,

WHEREAS, it is in the best interest of the citizens of the Metropolitan Government of Nashville and Davidson County that Amendment 1 be approved.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That Amendment 1 to the participation agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Planning Department, and Sojourn Nolensville Apartments, LP, attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2.                     That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves the first amendment to the participation agreement between the Metropolitan Planning Department (“Metro”), and Sojourn Nolensville Apartments, LP, (“Developer”) to amend the scope of the agreement.

 

As approved by Ordinance No. BL2026-628, the Developer would provide enhanced pedestrian signaling at 4420 Taylor Road to serve its own development, Sojourn Nolensville Apartments, and existing properties in the area. Amendments to BL2026-628 may be made by resolution of the Metropolitan Council.

 

Pursuant to the participation agreement, the Developer will remove existing concrete and curb and install one arm mast pole with signals and signs, two pedestrian ramps, one crosswalk marking in between the curb ramps, two stop line pavement markings, one pedestrian push button pole, a handrail along the back side of a curb ramp and sidewalk, and new sidewalk between the existing sidewalk and curb, all in compliance will the requirements and specifications of Metro.

 

Metro will inspect the construction and, upon acceptance, will be responsible for ongoing operation and maintenance of the pedestrian signaling. Metro will pay $217,545 toward these improvements, payable on a reimbursement basis.

 

Fiscal Note: This amendment modifies the pedestrian crossings to be constructed near the intersection of Nolensville Pike and Taylor Road and increases Metro’s project share from $178,023 to $217,545.
