An ordinance amending Section 4.12.010 of the Metropolitan Code pertaining to the definition of Competitive bidding in accordance with Title 12, Chapter 3, Part 12 of the Tennessee Code Annotated.

WHEREAS, T.C.A. § 12-3-1212 enables local governmental entities with a full-time purchasing agent to increase the threshold over which public advertisement and sealed competitive bids or proposals are required for purchases to an amount not to exceed fifty thousand dollars ($50,000); and,
WHEREAS, the Metropolitan Government of Nashville and Davidson County’s (“Metro”) current threshold for competitive bidding is $25,000.00 and was set at that level to match the maximum allowable threshold previously set by the state; and,
WHEREAS, the state of Tennessee has since increased that threshold to $50,000.00 in recognition of inflation and reduced buying power of the previous limit; and,
WHEREAS, increasing this threshold will help reduce procurement cycle times and deliver goods and services more quickly to the departments of Metro; and,
WHEREAS, the Purchasing Agent recommends that the threshold over which competitive bidding is required for purchases be increased to the maximum amount permitted by state law.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. Section 4.12.010 of the Metropolitan Code of Laws is hereby amended by deleting the definition of “Competitive bidding” in its entirety and substituting in lieu thereof the following:
“Competitive bidding” means:

Where availability exists, at least one (1) of the three (3) written quotes shall be solicited from a certified minority-owned business enterprise (MBE) or women-owned business enterprise (WBE). Where availability exists, at least one (1) of the three (3) written quotes shall be solicited from a certified small business enterprise (SBE) or service-disabled veteran owned enterprise (SDV). |

Competitive sealed bids or request for proposals. |
The above dollar thresholds shall be inclusive of the total project cost up to a maximum term of 60 months. The department shall award to the offer they determine most advantageous to Metro.
Section 2. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
