A resolution to amend Ordinance No. BL2024-239 to authorize The Metropolitan Government of Nashville and Davidson County to abandon additional public water mains, fire hydrant assemblies and easements, for property located at 1 Terminal Drive, also known as BNA Concourse D Expansion (MWS Project No. 23-WL-97 and Proposal No. 2023M-216ES-002).

WHEREAS, Ordinance No. BL2024-239, approved March 20 2024, authorized the abandonment of approximately 890 linear feet of existing 12-inch water main (DIP), two fire hydrants and easements, for property located at 1 Terminal Drive, also known as BNA Concourse D Expansion; and,
WHEREAS, the abandonment of an additional approximately 495 linear feet of existing 12-inch water main, approximately 280 linear feet of existing 10-inch water main, two additional fire hydrant assemblies and easements, are needed to construct Project No. 23-WL-97; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-216ES-002 on February 29, 2024, for revisions to the original mandatory referral; and,
WHEREAS, Ordinance No. BL2024-239 provides that amendments to the legislation shall be approved by resolution.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the ordinance No. BL2024-239 is hereby amended by deleting section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 1,385 linear feet of existing 12-inch water main, approximately 280 linear feet of existing 10-inch water main, four fire hydrant assemblies and easements, for property located at 1 Terminal Drive, also known as BNA Concourse D Expansion, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this resolution.
Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
