A resolution authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing public sanitary sewer main, and to accept new public sanitary sewer main and sanitary sewer manhole, for property located at 3862 Dickerson Pike, also known as Kemp Parking Lot, (MWS Project No. 24_SL_191 and Proposal No. 2025M-121ES-001).

WHEREAS, the abandonment of approximately 247 linear feet of existing eight-inch sanitary sewer main (PVC), and the acceptance of approximately 205 linear feet of new eight-inch sanitary sewer main (DIP) and one sanitary sewer manhole, for property located at 3862 Dickerson Pike, also known as Kemp Parking Lot, are needed to construct project number 24-SL-191; and,
WHEREAS, BL2024-345 authorizes the Metropolitan Department of Water and Sewerage Services to approve extensions, additions, improvement, or works by resolution of the Metropolitan Council; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2025M_121ES-001 on July 22, 2025, for the abandonment and acceptance of said sanitary sewer mains and sanitary sewer manhole.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 247 linear feet of existing eight-inch sanitary sewer main (PVC), and to accept approximately 205 linear feet of new eight-inch sanitary sewer main (DIP) and one sanitary sewer manhole, for property located at 3862 Dickerson Pike, also known as Kemp Parking Lot, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.
Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Tennessee Code Annotated section 7-35-406(a)(2) and Ordinance No. BL2024-345 allow the Metropolitan Department of Water and Sewerage Services to approve extensions, additions, or works by resolution of the Metropolitan Council.
