WHEREAS, the abandonment of approximately 468 linear feet of existing six inch water main, approximately 697 linear feet of existing eight inch water main, approximately 310 linear feet of existing ten inch sanitary sewer main, approximately 196 linear feet of existing 12 inch sanitary sewer main, one fire hydrant assembly, four sanitary sewer manholes and easements, and the acceptance of approximately 43 linear feet of new six inch water main (DIP), approximately 903 linear feet of new eight inch water main (DIP), approximately 474 linear feet of new ten inch sanitary sewer main (DIP), two fire hydrant assemblies, four sanitary sewer manholes and easements, for property located at 1420 Adams Street, also known as Modera Germantown, are needed to construct project numbers 20-WL-56 and 20-SL-100; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2020M-093ES-001 on October 30, 2020, for the abandonment and acceptance of said water and sanitary sewer mains, fire hydrant assemblies, sanitary sewer manholes, and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 468 linear feet of existing six inch water main, approximately 697 linear feet of existing eight inch water main, approximately 310 linear feet of existing ten inch sanitary sewer main, approximately 196 linear feet of existing 12 inch sanitary sewer main, one fire hydrant assembly, four sanitary sewer manholes and easements, and the acceptance of approximately 43 linear feet of new six inch water main (DIP), approximately 903 linear feet of new eight inch water main (DIP), approximately 474 linear feet of new ten inch sanitary sewer main (DIP), two fire hydrant assemblies, four sanitary sewer manholes and easements, for property located at 1420 Adams Street, also known as Modera Germantown, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance abandons water and sewer mains, a fire hydrant assembly, and four sewer manholes, along with the associated easements, and accepts replacement water main, sewer main, two fire hydrant assemblies, four sewer manholes, and easements for property located at 1420 Adams Street, also known as Modera Germantown. This ordinance has been approved by the planning commission. Future amendments to this legislation may be approved by resolution.
