A resolution authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer mains, and to accept new public sanitary sewer mains, at eight properties located on New York Avenue, off-site of the project location at 1701 54th Avenue North and 1710 54th Avenue North, also known as Modera Nations Offsite (MWS Project No. 24-SL-193 and Proposal No. 2024M-116ES-001).

WHEREAS, the abandonment of approximately 379 linear feet of existing eight-inch sanitary sewer main (VCP), and the acceptance of approximately 379 linear feet of new 10-inch sanitary sewer main (PVC), from properties at 5612 B New York Avenue to 5600 B New York Avenue in the public right-of-way of Alley #1212, off-site of the project location at 1701 54th Avenue North and 1710 54th Avenue North, also known as Modera Nations Offsite, are needed to construct project number 24-SL-193; and,
WHEREAS, the abandonment of approximately 151 linear feet of existing 10-inch sanitary sewer main (VCP), and the acceptance of approximately 151 linear feet of new 12-inch sanitary sewer main (PVC), at property located at 5601 New York Avenue, off-site of the project location at 1701 54th Avenue North and 1710 54th Avenue North, also known as Modera Nations Offsite, are needed to construct project number 24-SL-193; and,
WHEREAS, BL2024-345 authorizes the Metropolitan Department of Water and Sewerage Services to approve extensions, additions, improvement, or works by resolution of the Metropolitan Council; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2024M-116ES-001 on September 20, 2024, for the abandonment and acceptance of said sanitary sewer mains.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon 379 linear feet of existing eight-inch sanitary sewer main (VCP) and approximately 151 linear feet of existing 10-inch sanitary sewer main (VCP), and to accept approximately 379 linear feet of new 10-inch sanitary sewer main (PVC) and approximately 151 linear feet of new 12-inch sanitary sewer main (PVC), at eight properties located on New York Avenue, off-site of the project location at 1701 54th Avenue North and 1710 54th Avenue North, also known as Modera Nations Offsite, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.
Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.
Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution also abandons approximately 151 linear feet of existing 10-inch sanitary sewer main (VCP), and accepts approximately 151 linear feet of new 12-inch sanitary sewer main (PVC), at property located at 5601 New York Avenue, off-site of the project location at 1701 54th Avenue North and 1710 54th Avenue North, also known as Modera Nations Offsite.
Tennessee Code Annotated § 7-35-406(a)(2) and Ordinance No. BL2024-345 allow the Metropolitan Department of Water and Sewerage Services to approve extensions, additions, or works by resolution of the Metropolitan Council.
This proposal has been approved by the Planning Commission.
