An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing brick water pumping station building located at 2124 Oakwood Avenue but to retain the Public Utility & Drainage Easement (Proposal No. 2023M-160ES-001).

WHEREAS, the existing brick water pumping station building, for property located at 2124 Oakwood Avenue, is no longer needed; and,
WHEREAS, the water pumping station is no longer in service and has been removed from the building; and,
WHEREAS, the remaining Public Utility & Drainage Easement, as shown in Plat Book 4600, Page 186, Davidson County Register of Deeds, will be retained; and,
WHEREAS, the abandonment has been requested by Jerry A. Gingerich and Judith Ellen Gingerich, owners; and,
WHEREAS, upon final approval of this Ordinance, the attached Release (Exhibit 1) will be recorded indicating ownership of the brick water pumping station building is transferred to 2124 Oakwood Avenue; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-160ES-001 on October 19, 2023, for the abandonment of said brick water pumping station building and the retention of the Public Utility & Drainage Easement.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon the existing brick water pumping station building and to retain the remaining Public Utility & Drainage Easement, for property located at 2124 Oakwood Avenue, as shown below and on Exhibit 1, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
