A resolution requesting that the various authorities and agencies of the Metropolitan Government adopt procurement policies that align with the Procurement Code and the related procurement regulations of the Metropolitan Government of Nashville and Davidson County.

WHEREAS, the Division of Purchases of the Metropolitan Department of Finance (“the Procurement Division”), is the central point of contact for buying goods and securing services for the Metropolitan Government of Nashville and Davidson County; and
WHEREAS, departments of the Metropolitan Government must utilize the procurement services of the Procurement Division as governed by the Procurement Code in Title 4 of the Metropolitan Code of Laws and the related Regulations to the Procurement Code as adopted by the Procurement Standards Board; and
WHEREAS, several authorities of the Metropolitan Government, including, but not limited to, the Metropolitan Convention Center Authority, the Metropolitan Sports Authority, the East Bank Development Authority, and the Metropolitan Nashville Airport Authority were created under state enabling legislation and as such are not obligated to utilize the procurement services of the Procurement Division; and
WHEREAS, the Metropolitan Development and Housing Agency, Metropolitan Board of Education, the Nashville Electric Service, Metropolitan Transit Authority, and the Hospital Authority are expressly exempted by the Metropolitan Charter and Code from an obligation to utilize the procurement services of the Procurement Division; and
WHEREAS, while these agencies and authorities of the Metropolitan Government may not be required to utilize the procurement services of the Procurement Division, state public contracting laws require that they engage in competitive procurement practices; and
WHEREAS, while the procurement work of these authorities and agencies has not been subject to any apparent problems, it would benefit all parts of the Metropolitan Government to operate under the same set of standards and policies for the purchase of goods and services; and
WHEREAS, the procurement policies of the authorities and agencies should address the Procurement Code evaluation criteria and scoring provisions, as well as, solicitation and award protest provisions; and
WHEREAS, it is fitting and proper for the Metropolitan Council to request the various authorities and agencies of the Metropolitan Government to align their procurement policies and standards with those of the Procurement Code and the Procurement Division of the Department of Finance.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Metropolitan Council hereby goes on record as requesting the various authorities and agencies of the Metropolitan Government to adopt procurement policies that align with the Procurement Code and the related procurement regulations of the Metropolitan Government of Nashville and Davidson County.
Section 2. This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
