WHEREAS, RS2021-1104 approved an intergovernmental agreement between TDOT and NDOT for the Charlotte Avenue/Dr. Martin L. King, Jr. Boulevard Transit Headways and Congestion Management Project (“the Agreement”); and,
WHEREAS, as set forth in Amendment 1, attached hereto, the parties desire to amend the Agreement to replace Exhibit A to the Agreement in its entirety with a new Exhibit A that reflects a change in project costs and extends the project completion date from September 30, 2024 to June 30, 2026;
WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b), authorizes the Metropolitan Council to approve an agreement with TDOT by resolution; and,
WHEREAS, it is in the interest of the Metropolitan Government of Nashville and Davidson County that this Amendment 1 be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Amendment 1 to the Intergovernmental Agreement by and between the State of Tennessee, Department of Transportation, and the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Transportation and Multimodal Infrastructure, for the Charlotte Avenue/Dr. Martin L. King, Jr. Boulevard Transit Headways and Congestion Management Project, attached hereto and incorporated herein by reference, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.
Section 3. That this Amendment One to the resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves the first amendment to an intergovernmental agreement between the Tennessee Department of Transportation (“TDOT”) and the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”) previously approved pursuant to Resolution No. RS2021-1104. The agreement is for the Charlotte Avenue/Dr. Martin L King, Jr Blvd Transit Headways and Congestion Management Project. This project includes the deployment of transit signal priority system, connect vehicle roadside units and onboard units, fiber optic communications, digital signage at bus stations, and software systems.
The amendment under consideration replaces Exhibit A to the agreement, which impacts the breakdown of the project costs. The amendment does not change the total project cost, which will remain $3,000,000, with Metro responsible for $500,000, TDOT responsible for $1,000,000, and the Federal Highway Administration responsible for $1,500,000.
The amendment will extend the project completion date from September 30, 2024, to June 30, 2026.
Fiscal Note: This amendment changes the phase cost breakdown outlined in Exhibit A and will not change the total project cost.
