A resolution to amend Ordinance No. BL2022-1588 to authorize The Metropolitan Government of Nashville and Davidson County to abandon additional sanitary sewer mains, sanitary sewer manholes and easements, and to update the map and parcel information, for now two properties located at 110 Jo Johnston Avenue and 500 2nd Avenue North, also known as Metro Permanent Supportive Housing (MWS Project Nos. 22-WL-105 and 22-SL-37, and Proposal No. 2023M-118ES-001).

WHEREAS, Ordinance No. BL2022-1588, approved January 4, 2023, authorized the abandonment of approximately 115 linear feet of existing 12 inch and eight inch sanitary sewer main and one sanitary sewer manhole, the relocation of one fire hydrant assembly, and the acceptance of approximately 115 linear feet of new 12 inch sanitary sewer main (DIP) and two sanitary sewer manholes, for property located at 110 Jo Johnston Avenue, also known as Metro Permanent Supportive Housing; and,
WHEREAS, the abandonment of an approximately 284 linear feet of existing 10-inch sanitary sewer main, the abandonment of an additional approximately 49 linear feet of existing 12-inch sanitary sewer main, two additional sanitary sewer manholes and easements, for now two properties located at 110 Jo Johnston Avenue and 500 2nd Avenue North, are needed to construct Project Nos. 22-WL-105, and 22-SL-37; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-118ES-001 on July 26, 2023, for the abandonment of said sanitary sewer mains, sanitary sewer manholes and easements and update to map and parcel information; and,
WHEREAS, Ordinance No. BL2022-1588 provides that amendments to the legislation shall be approved by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Ordinance No. BL2022-1588 is hereby amended by deleting Section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 133 feet of existing 12-inch sanitary sewer main (VCP), approximately 31 linear feet of existing eight-inch sanitary sewer main (VCP), approximately 284 linear feet of existing 10-inch sanitary sewer main (VCP), three sanitary sewer manholes and easements, the relocation of one fire hydrant assembly, and the acceptance of approximately 115 linear feet of new 12-inch sanitary sewer main (PVC), two sanitary sewer manholes and easements, for two properties located at 110 Jo Johnston Avenue and 500 2nd Avenue North, also known as Metro Permanent Supportive Housing, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.
Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
