A resolution authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing public sanitary sewer main, and to accept new public sanitary sewer manhole, for properties located at 401 S 4th Street, also known as Shelby House Phase 2 (MWS Project No. 25-SL-160 and Proposal No. 2026M-009ES-001).

WHEREAS, the abandonment of approximately 297 linear feet of existing 10-inch sanitary sewer main, and the acceptance of one sanitary sewer manhole, for properties located at 401 S 4th Street, also known as Shelby House Phase 2, are needed to construct project number 25-SL-160; and,

WHEREAS, BL2024-345 authorizes the Metropolitan Department of Water and Sewerage Services to approve extensions, additions, improvement, or works by resolution of the Metropolitan Council; and,

WHEREAS, the Metropolitan Planning Commission approved with conditions mandatory referral No. 2026M-009ES-001 on, February 10, 2026, for the abandonment and acceptance of said sanitary sewer main and sanitary sewer manhole; and,

WHEREAS, NES’s condition that all work must maintain clearances with any utility poles to prevent undermining the integrity of the base of the poles, will be met as this is standard practice.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 297 linear feet of existing 10-inch sanitary sewer main, and to accept one sanitary sewer manhole, for properties located at 401 S 4th Street, also known as Shelby House Phase 2, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.

Section 3.                     This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Tennessee Code Annotated section 7-35-406(a)(2) and Ordinance No. BL2024-345 allow the Metropolitan Department of Water and Sewerage Services to approve extension, additions, or works by resolution of the Metropolitan Council.

 

This proposal has been approved by the Planning Commission.
