An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing public sanitary sewer main, sanitary sewer manhole and easements, and to accept new sanitary sewer main, sanitary sewer manholes and easements, for property located at Garfield Street (unnumbered), also known as 808 Gateway Germantown development (MWS Project No. 16-SL-88 and Proposal No. 2020M-076ES-001).

WHEREAS, the abandonment of approximately 216 linear feet of existing 10 inch sanitary sewer main, one sanitary sewer manhole and easements, and the acceptance of approximately 619 linear feet of new 10 inch sanitary sewer main (PVC), three sanitary sewer manholes and easements, for property located at Garfield Street (unnumbered), also known as 808 Gateway Germantown development, are needed to construct project number 16-SL-88; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2020M-076ES-001 on September 3, 2020, for the abandonment and acceptance of said sanitary sewer mains, sanitary sewer manholes and easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 216 linear feet of existing 10 inch sanitary sewer main, one sanitary sewer manhole and easements, and to accept approximately 619 linear feet of new 10 inch sanitary sewer main (PVC), three sanitary sewer manholes and easements, for property located at Garfield Street (unnumbered), also known as 808 Gateway Germantown, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
